That's not how the system works. She is at fault.

So I decided to not file a police report or pursue any action.

Police reports are not needed and won't exist in traffic accidents unless they are called to the scene. Many traffic accidents, including every accident I have ever been involved in, get resolved between the parties without police involvement.

If she or her insurance agency find out my license isn't valid, she can sue >me for being in the street for her to rear end me in the first place and this will be the case every time.

What do you mean your license isn't valid? Are you talking about your drivers license is no longer valid in another state? Licenses are still valid if they are valid in another state. If your car isn't registered in the state that you live in, with the corresponding plates, that doesn't matter for purposes of car accidents. That is potentially a safety / emissions law violation which is something else entirely and something you can get ticket'd for. But it would have no impact on a traffic accident that you are not at fault for.

You don't need to. You take your car in, get an estimate of how much it costs to repair it, then call her car insurance company and demand they pay it. Only if they don't pay it do you take the legal action route against HER. You make no mention of your drivers license or registration issues of your car. This is about getting your property fixed in regards to the incident on such-and-such date. Anything else is irrelevant.

It is your responsibility to file a claim against HER insurance. So it's currently between you and HER insurance company and nobody else. Unless they try to get out of paying.

It sounds like you are letting trivial things get in the way of getting what you are owed. I too have been rear ended at a stop light by somebody that was texting / talking on their phone. Happened not even a year after buying a brand new car. Sh*t happens but her insurance paid when I called them. They gave me a number to fax the bill.

Stop complaining, get an estimate for repairs and THEN call her insurance. Tell them you are seeking compensation for getting rear ended at a traffic light on such-and-such date by such-and-such person and they'll tell you how to get the bill to them so they can pay it.

This same thing happened to me. But I was driving a Ford E150 van with one of those big heavy thick silver bumpers that vehicles used to have. The girl really fucked up her car bad. Even air bag deployment. Cop shows up and while she did get a ticket, she somehow got it dismissed when she appealed it in court. At the time I was minimally insured. The bumper had a large dent in it. I went to one of those lots with old cars. They showed me one, it looked good. I paid while they took it off. I paid a pre-mechanic student $20.00 to take off the old one and put on the new one. I think it was like literally 2 or 4 bolts.
