I go to a pretty big (30,000+ students) public university in Iowa. Today I received an email from the University stating that a sexual assault had occurred in the dorms on campus. The message then went on to list the university's policy on sexual misconduct, sexual assault, and sexual harassment involving students. I skimmed through the email and one part of the message caught my attention. The university's policy stated that people who are under the influence of drugs, alcohol, or medication are "mentally incapacitated" and thus are unable to give consent. They then link to Iowa Code 709.1A that states, "Mentally incapacitated means that a person is temporarily incapable of apprising or controlling the person's own conduct due to the influence of a narcotic, anesthetic, or intoxicating substance". I don't drink myself and have never been on any kind of medication, but am aware of alcohol's role as a social lubricant to initiate sexual encounters and I also know many people who take an absurd amount of medications every day (they tend to have large swings in emotion and behavior due to this). With the abundant usage of alcohol, drugs (adderall is very common on college campuses), and other prescription medications in today's society, I wanted to know your thoughts on the idea of consent in a world where so many people are pumped full of drugs (illegal,legal, prescribed, or whatever) at any given time.
