Situation:

  • I'm being happily divorced by my initiative after 4 years. Not living together for a year already.
  • We got the home bought in mortgage after the marriage
  • Throughout the marriage, she was always worried that if we were to divorce, I'm going to take away the house, to which I answered "I don't need your damn house", because at that time I didn't know the value of money. She has no written record of me saying that.
  • She has paid the down-payment and I paid half of monthly mortgage payments.
  • The house value increased 70% over these years.
  • I hate the bitch
  • currently the suggestion is that she keeps the house and I get back the mortgage payments I made, worth about 3% of the house price.

So on the one hand, I have verbally committed that I will not claim half of the house if we were to divorce. She did not cheat or anything, and is generally an OK person.

On the other hand, I'll hardly be able to afford a down-payment myself in the next 7-10 years if I was to buy another place. My income is half of hers. If the situation was reversed she'd probably take away as much as she can.

I am planning to ask for 10% of the value of the house, which sounds like a good deal to me and probably to her too.

From TRP perspective, am I being a pussy or should I stick to commitments?
