The spread of false information or inflammatory or threatening statements about the perpetrators or the crime itself reduces public safety and may violate federal law.

So the prosecutor knows that this could violate public safety, but only does something about it when it is politically beneficial.

On the upside, at least we have precedence for this opinion.

Statements like the original statement that came out of the prosecutor's office are what are called trial balloons. The authoritarians among us are exploring just what they can and can't get away with in 2016, always seeking to push their agenda forward.
