There is a concept in law called "assumption of risk" that I think applies here. At its most basic form, it holds that a person is responsible for the results of dangerous actions that they deliberately and without coercion took part in. Either way, this source is still making the assumption that anything other than a conviction is an unpunished rapist. They discount even the possibility of a person being acquitted (or a case dismissed etc) because they were actually innocent.

That's not how false allegations are treated for any other crime. If you accuse someone of theft and they are acquitted in court, you aren't charged with anything unless there is hard evidence that you knew your allegation was false. People have lost the point of "apples to oranges". It's supposed to mean that you shouldn't judge one thing by the standards of another. Example: you wouldn't say "this is a bad apple because I can't peel it with my bare hands" because that's a feature of oranges, not apples.
