Non payment of child support isn't a criminal charge. It has to be a court order violation. If she never took you to court you can't be arrested. You're not legally required to give her anything at that point. For actual orders it's something like not paying for a year and having over $5,000 owed. This isn't something that just pops up and a man is arrested. A lot of kids never get support and those men don't end up in prison.
