Rape by deception is a thing. It's just a grey area how much you have to deceive someone for it to count as rape. Think of it being like "Whites Only Night", where anybody of color isn't allowed. You think that would go over well? Gym memberships generally don't allow 24/7 use of the facilities. My local center is closed at certain hours for school use and various other activities. It's completely normal and reasonable. I'd guess it's something like 80% of women and 5% of guys that would prefer to train without the other sex around. If they misled him then that's one thing, but I think the hours he can use the gym would be part of the contract he signed up for. They could have a male only hour but the males wouldn't want that and would probably prefer to go in a mixed hour so you're basically asking for them to lose business by having an unnecessary male only hour to even it up.
