I’ve never heard of a Duke Order, but I’d be shocked if it has any impact on the l under, as they are a not a party to your marriage and made a credit decision based on the financial condition of the combined parties on the loan. I don’t think a court can, as part of a divorce, adversely rule against a third party lender’s security interest or risk profile of their borrower to facilitate them terminating a marriage.

Girlfriend may be right and looking out for your best interests. You own a new house which former wife may have a claim to technically as marital property since you never officially divorced.
