The case came under Scottish law - and it was not a Private Criminal Prosecution but a Civil liability and damages case. You can't Pursue a civil case whilst a realted criminal case is tried, but once completed you can sue for civil damages. It is not a feminist issue, simply a difference in standards of evidence and no Jury. Under UK law in a criminal trial unless there is Evidence beyond a reasonable doubt you may not convict. There is generally a Jury, unless for security reasons such as Terrorism a Jury is at risk. In civil trials it's balance of probabilities so any preponderance of evidence greater than 50% wins the case. No Jury, Just a Judge. In the US the same arose when OJ Simpson walked free but was sued for civil damages…
