Refusing custody of the childrenYou can refuse to see your kids but your ex would get more in child support since she’ll have the kids 100% of the time. Alimony is separate from child support. Don’t believe everything you read online. | /r/Divorce_Men | 09/10/23 10:14 PM
Afterschool costs? Whose responsible? No and that’s her problem. She should find alternative care that is on her days. A neighbor, classmates parent or a high school student if it’s just for after school care. | /r/Divorce_Men | 08/09/23 03:07 AM
My spouse wants to get a divorce in a different state with different lawsFile asap so they can’t in Ohio. | /r/Divorce_Men | 12/07/23 07:11 PM
She won't leave me aloneThe first thing they ask for at the start of this process is your financials. Then will proceeds to bleed you dry until you have nothing left. When that happens, suddenly your case will end and you’re left with nothing. Courts are a business. | /r/Divorce_Men | 28/02/23 12:34 AM
She really hates to see me happy…Can’t you just drive your daughter back to ex’s house since you’ve been blocked? Who knows, maybe it’s a set up and she’s trying to get you to her house. If that’s even a slim possibility, I’d get a police escort. | /r/Divorce_Men | 23/01/23 04:14 AM
Divorce in CA or IL? 3 kids. No assets. So is Illinois. Except maybe for the southern part of the state. Anything around the Chicago area men get screwed. | /r/Divorce_Men | 04/01/23 02:30 PM
Women who lurk in the Men's Divorce subreddit, why are you here?I came here when my husbands ex was taking him to court, once again. This time for college tuition. This after both her and their son kept it a secret they were moving out of state right after HS graduation. Was just going to skip town and tell him afterwards. Unfortunately for her, his high school slipped up during his IEP meeting and thought he already knew. Reading all your stories is extreme similar to what she did to him during their divorce. TRO and all. Over the 12 years we’ve been togeth… | /r/Divorce_Men | 31/12/22 09:45 PM
[US-IL, child support]What does your CS order say? Also in Illinois and my husband had to pay his ex half of all childcare expenses including full day summer camps. This was up until the age of 13. She had full legal and residential custody. Now if you have 50/50 then while the child is with her she’s responsible to pay for childcare just like you’d be when the child is with you. | /r/Divorce_Men | 27/11/22 03:50 AM
Can my wife stay on my health insurance after we are divorced? That’s a question for your HR department. Some divorce decrees have it written that you have to supply health insurance short term around six months. After that she’s be on her own. After divorce she’d no longer be a dependent so I’m not sure how keeping her on long term would be possible. | /r/Divorce_Men | 21/11/22 03:01 PM
HolidaysIs there a court order that states he gets every other weekend and alternating holidays? If yes and she won’t “allow it” take her back to court for contempt. If there is no court order, not much you can do until he gets one. | /r/Divorce_Men | 11/11/22 04:12 PM
My SO states that they would just like child support, and maybe some cash assets, nothing else. Thoughts?Every child support order at one time or another can become modifiable. What was written five years ago and accepted by both parties can be easily modified by the courts if need be. Just because she wants a lump sum now doesn’t mean in 8 years when she wants your child to be enrolled in private school, take music lessons and join multiple sports, that she will want monthly support. And let’s not forget about college and medical costs. The average cost of raising a child to the age of 18 is over … | /r/Divorce_Men | 19/10/22 08:53 PM
Protecting asset during divorceDoes she work? If no, you’re using marital $$ to buy real estate for your parents. Does she know about this? Courts may look at it as you trying to hide assets. | /r/Divorce_Men | 24/09/22 07:47 PM

CS issue and half of college 5 years post divorce. Need adviceSurprised you didn’t have it written that you are allowed all access to courses, grades and attendance. Your children would have to grant you authority and if they refuse, support will be cut off. Dealing with something similar right now. Kid is in year three of community college which means he’s not going full time. That’s in our agreement. Son won’t respond to questions and ex has held onto 5 months of checks for college. His college started 8/29 yet no info from ex on where he’s going. Until … | /r/Divorce_Men | 13/09/22 01:41 PM
Another question, if I’m still married and buy a house in my name, can she still take half the funds or the house?Yes, don’t purchase anything until the divorce is final. | /r/Divorce_Men | 29/08/22 02:49 PM
My friend thinks he is being abused. Can he move out while he is seeking a divorce or legal separation? If he’s being abused, he can file a TRO and get her removed from the home. Tell him to start documenting his abuse with audio and video recordings. | /r/Divorce_Men | 20/08/22 06:47 PM
Asking %50 after years of no custody! So he left his kids when one was a newborn and the other two years old. He hasn’t seen them at all in 10 years? Paying child support and visitation are two different things. I highly doubt any judge will give him 50/50. He’s going to first have supervised visitation since he’s had no relationship with his kids, then shoot for visitation with overnight visits. Maybe after a year or two if things are going well, try for 50/50. | /r/Divorce_Men | 14/08/22 07:15 PM
Sharing child care costs when my child isn't with meEquitable share. Look into it. If she’s making 30% more than you, nothing should be 50/50. I’d also question $500 a week for childcare. How many hours a day are we talking? Is there a contract? | /r/Divorce_Men | 13/08/22 03:27 AM
Any idea why the judge wouldn't sign an agreement to get my belongings?Because the courts are a business. Now you’re going to have to pay your attorney even more money & more court fees to get this resolved. Judges and lawyers live off this. That’s why the very first thing you provide when you start the process of divorce is your financials. This way they know just how long they can drag things out before you run the risk of not being able to pay. | /r/Divorce_Men | 05/08/22 06:38 PM
first post ever: i am just starting this process, and so far she is being very civil about everythingThe dog is the start. If she gets away with taking your dog, she’ll take even more. Hire an attorney and get it done the right way. | /r/Divorce_Men | 04/08/22 02:48 AM

Mental evaluation questionIf one person knows they’re recording and the other person doesn’t, it gives them an unfair advantage. You’ve been with your wife long enough to know what sets her off. It would very easy to provoke her into going off on you. Same if she has been recording you. You said it yourself; your emotions are all over the place. You are normally a logical person. A judge could listen or watch her recordings and deem you unfit. You may offend the judge or not. Many years ago a friend of mine was going thr… | /r/Divorce_Men | 27/07/22 07:28 PM
Mental evaluation questionI highly doubt a judge would allow those videos and recordings. What led up to her behaving like this? Was she provoked by you because you wanted to get her “acting crazy”? Was she aware you were recording her? I think everyone at some point in their lives have acted and behaved in a manner that others would deem crazy. The best thing you can do is be honest with your answers. | 8 | Stop working before Divorce. It’s not that easy. Tax returns will be asked for. If in the past 4 years he’s been continually making say $100,000 and then all of a sudden it drops to $50,000 the courts are going to want to know why. Same when a woman says she “can’t work”. The courts will say based off her education, age etc, she could easily get a job paying $60,000. | /r/Divorce_Men | 18/07/22 04:48 PM
Stop working before Divorce.Just make sure you have your mental health well documented by a psychiatrist & therapist. | /r/Divorce_Men | 18/07/22 03:48 PM
Stop working before Divorce.Probably not a good idea. The judge will see through what you’re trying to do. If you go from a multiple six figures to say $50,000 it’s not going to look good for you. | /r/Divorce_Men | 18/07/22 01:57 PM
Life Insurance Trust FundShe and the kids wouldn’t lose out. If you’re in the US and have paid into Social Security, your children would receive SS Survivors Benefits until the are 18 or graduates from high school. That money is tax free, just like child support. If you’ve been paying in for decades, SS would pay A LOT more per month than child support. | /r/Divorce_Men | 30/06/22 05:35 PM

Going through this right now in another state. He’s 20 and it’s taking him three years to get his associates degree. I’d advise getting a lawyer immediately. | 25 | So, I got banned from divorce sub.Don’t feel bad. I was permanently banned from the low libido sub. A woman hasn’t had sex with her husband for over 4 years. During that time, he stopped all affection;no kissing, hand holding, date nights or compliments. She didn’t think it was fair the way he was behaving. She went to a divorce lawyer but since she makes more than him, she’d lose a lot. | 1 | $3.7k a month too much?So she’s medically unable to work but is well enough to care for a child? How old is your child? | /r/Divorce_Men | 01/04/22 02:32 AM |
$3.7k a month too much?Wait a second. She’s unable to work? How is she going to support herself? Who will be paying her medical insurance? Is she also expecting alimony? As you’re well aware of, child support is suppose to be for the care of the child. If she has no income, couldn’t you argue that you fear the $3,700 a month won’t be going solely to to the care of your child? | /r/Divorce_Men | 01/04/22 02:23 AM

Ex wife demanding allergy testIf your ex is that concerned, she can bring her in to be tested but make sure you are provided a copy of the results. | 16 | Just sharing: Child Custody - A license to make a father's life a living hell on an unlimited basisMy attorney told me “everything is modifiable”. Nothing is ever set in stone. Just because you have a 20-30 page document that spells everything out from A-Z doesn’t mean it can’t be modified down the line. | /r/Divorce_Men | 21/03/22 02:07 AM
Mother of child no longer agreeing to co-parent?Is this a court ordered parenting agreement or something the two of you decided on? If it’s court ordered take her back for contempt. If not, lawyer up and go for full custody with her getting visitation. | /r/Divorce_Men | 09/03/22 02:41 AM
I just don’t understand.Document every single time you’re asked. What reason, how long etc. Keep track of everything. Give her a few months to hang herself then take her back to court and insist on full custody. | /r/Divorce_Men | 07/03/22 12:13 AM
Gathering evidence, need advice on how to get videoBetter make very sure of the laws in your state with illegal video footage. You could be in way more trouble than she. A buddy of mine knew his ex wife was doing coke while her kids were with her. He took photos of her from the outside of her residence and it clearly shows what she’s doing and the kids being there with her. Judge reprimanded him for violating her privacy and through out his case. | /r/Divorce_Men | 03/03/22 04:28 AM
Canceled Vacation timeThe fact she “didn’t know his Covid status” is a huge win for you. From what you wrote, she “assumed” he was positive. He could have easily had something else that could have been managed at your home during visitation. | /r/Divorce_Men | 19/02/22 06:39 PM
How do you fight brainwashing and alienation of child by ex?Her being pregnant has nothing to do with the best interests of your child. She can move and have visitation. | /r/Divorce_Men | 09/01/22 11:31 PM
How do you fight brainwashing and alienation of child by ex?What’s in Alaska besides a new man? She will have a give a very valid reason for moving across the country. If it’s for a job, she’s have to prove that she couldn’t get the same type of job locally and that her only choice would be Alaska. Your previous post you said you both live in NYC. | 3 | Another Man Will Have More Time With My Child Than MeThe word “visitation” is a joke. You get a whopping 4 days to “visit” your child. Then as they get older, other interests will be more important to spending time with dad. Mom will make sure your child is submerged in sports and other activities that conveniently fall on your weekends. Then she moves 48 miles away, just making the 50 mile rule for relocation and now you’re spending your visitation taking them to their soccer games and hour away from where you live. | 5 | Health InsuranceOne month is not that big of a deal on her part. I’d ask for it and explain your reasoning. It’s not like you will not have any insurance after your divorce is finalized. I think it’s a reasonable request. | /r/Divorce_Men | 28/10/21 01:59 PM
As a young guy reading post from this thread…It’s okay to not want marriage & kids. The worst thing you could do for yourself and others involved is to do something you clearly don’t want. If a woman gives you an ultimatum, leave. Marriage and kids should never be used that way. If you want to further your decision, head over to DeadBedrooms. | /r/Divorce_Men | 09/10/21 01:02 PM
Liquidation of assets to prevent ex fromI would also recommend getting a Revocable Living Trust. It will spell out what you want done with your assets upon your death. Do not get a Will, those can easily be disputed in a court of law. With a trust, you will assign a trustee that will handle the distribution. You can decide how much, if any you want your children to receive. Your ex will not have any say. My trust has my kids not getting funds until they are 23. | 4 | Liquidation of assets to prevent ex fromNever seen that happen. At least in our state, your home and 401k/IRA are protected. Your ex can not go after that as a source of income. All that other stuff; rent, new car & luxury dinners would not be part of a CS order. You’re very lucky she was never your wife because you would probably be stuck paying alimony. Any issues that might affect me or my custody agreement? We both live in NY. Thank you.Every state is different on this issue, but can’t she collect unemployment? | 4 | father of two divorcing in TexasMy advice right now would be not to speak or interact with her at all. I guarantee she’s in the works of getting a restraining order for some alleged abuse. | 1 | This sh*t sucks..Well what does your child support order say? It should spell out exactly what it’s for. Usually medical, dental ect. along with work related child care and extracurricular activities is separate from child support. If she’s undiagnosed, can’t really use that against her. The judge will say you’re not a doctor. Unless she putting your children in danger with her actions. | /r/Divorce_Men | 27/08/21 01:40 PM

What’s in Georgia that she can’t do in NJ? If she’s allowed to move to Georgia, if she decides to uproot again to say California it won’t be that big of a deal in the eyes of the court. Fight hard for it now, otherwise it’ll be impossible later. | /r/Divorce_Men | 04/08/21 04:06 PM |
Seeking adviceYour first mistake was leaving the marital home. Unless she file a temporary restraining order (which is very common) you have every right to be there. How long have you been married? She’s already moving fast so you need to get an attorney ASAP. The longer you wait, the worse it’ll get. | /r/Divorce_Men | 03/08/21 04:06 PM
Change of Religion Leads To DivorceI don’t have the time nor energy to reply to this foolishness. I wish you luck in your divorce. | /r/Divorce_Men | 09/07/21 03:55 AM
Change of Religion Leads To DivorceCatholicism and all Christian religions are a cult. By definition of what a cult is, it’s another religion that breaks away from another major religion. Jesus was a Jewish rabbi. Catholicism & all Christianity broke away from the Jewish faith. Jesus returned to Heaven long before Christianity started. | /r/Divorce_Men | 09/07/21 03:10 AM
Change of Religion Leads To DivorceShe doesn’t want any more children. You should respect her decision. But since you have chosen not to, her only choice is divorce. Women aren’t solely put on this earth to make babies. This whole “have as many babies as god sees fit” is barbaric. | /r/Divorce_Men | 09/07/21 01:13 AM
Change of Religion Leads To DivorceGood luck. You’re going to need it. I’m glad for your ex wife that she woke up and realized that she doesn’t need to be your baby factory. | /r/Divorce_Men | 07/07/21 03:38 AM
Cause for concern? So do I. Best advice is to document everything. This way when you return to court, because eventually you will, you’ll have times, dates ect. Best advice husbands attorney gave him in regards to the divorce decree is “everything is modifiable”. | /r/Divorce_Men | 06/07/21 03:27 PM
Cause for concern? It’s very clear your ex wife or her family is talking negatively about you when your daughter is around. Kids hear things even when adults think they don’t. Telling a 5 year old that her dad cheated is just wrong. Your ex is grooming her for a lifetime of hate towards you. The things my husbands son has said to him throughout the years is mind blowing. An 8 year old child should not be telling their parent that according to mom or grandma & grandpa, they are worthless. He’s now an adult and cont… | /r/Divorce_Men | 06/07/21 02:39 PM
Childcare expense for teenagers questionYeah, my husbands ex tried that. She also tried to get past child care expenses from years prior. Her best friend from college watched him. When he asked for proof of payment to her, all he got was crickets. The judge knocked down childcare when he was 12 and wouldn’t allow the alleged past childcare expenses. | /r/Divorce_Men | 23/06/21 01:02 AM
Planning to file. I am not the bio dad of our son, who is 13, but I want primary custody. My wife lied to me about her infidelity and does not know that I know he isn’t mine. Can I make it known that she’s an adulterer without risking custody? In many states, if a woman is married and has a child, the husband is automatically considered as the father even if he is not. There was a story many years ago about a man who found out the child he thought was his wasn’t. The wife knew all along the child wasn’t his. Since the child wasn’t biologically his, he refused to pay child support. The judge said since he presumed he was the father for all those years and took on the role as the father, he was, in the eyes of the court legally responsi… | /r/Divorce_Men | 03/06/21 01:42 PM
What did you forget (or wish) to put in your divorce decree? Especially for visitation/child custody. Not just Illinois: Alabama, Connecticut, the District of Columbia, Hawaii, Illinois, Indiana, Iowa, Massachusetts, Mississippi, Missouri, New Hampshire, New Jersey, New York, North Dakota, Oregon, South Carolina, Utah and Washington | /r/Divorce_Men | 26/05/21 04:02 PM
What did you forget (or wish) to put in your divorce decree? Especially for visitation/child custody.Illinois and it’s law. As a divorced parent you are obligated to pay your “equitable share” of your adult child’s college expenses. And not just for college itself. You are also on the hook for a portion of ALL their expenses; food, car (insurance, gas ect) clothing, extracurricular activities, Spring Break and other holidays including 4 trips home a year. Also their health & dental insurance and a portion of those expenses. If married parents can’t afford college for their child, that’s the end… | /r/Divorce_Men | 26/05/21 03:03 PM
What did you forget (or wish) to put in your divorce decree? Especially for visitation/child custody. The best advice is: Just remember, everything in the divorce decree is modifiable. Nothing in it is written in stone. Geographic restrictions are great to have on paper but in 5 years a judge can say it’s okay for her to move 1,000 miles away for her job and take your kid(s) with her. Laws are always changing. For example; my husband’s decree from 2011 has that he’s responsible for half of his kids college education & expenses until he’s 26. In 2016, our state made changes to college expenses an… | /r/Divorce_Men | 26/05/21 01:24 PM
Intimate videos in interrogatoriesJust seems like an odd request. She’s making the assumption that you have intimate photos and videos. Couldn’t you then ask the same of her? If you haven’t already done so, the only contact you should be having with her should be through your attorney. | /r/Divorce_Men | 10/05/21 09:53 PM

Gender busting the property settlement .... Employed wife providing support for ex hubby post divorceNot always true. When my husband and his ex divorced, she was making six figures (close to $200,000) and he was making much, much less. He was ordered to pay $700 a month in child support plus half of all medical, dental and child care for ONE CHILD. When he couldn’t pay, she’d take him to court. She filed 30 plus motions during the divorce. She got the house but foreclosed. Left the water on but had the gas turned off. No heat = busted pipes in the house; massive water damage. He wasn’t on the … | /r/Divorce_Men | 27/04/21 09:53 PM
