Living together also complicates things - in certain states, they can argue for common law marriage. I know someone who insisted in having two different places, and he paid the rent for her. It worked out better actually and they have two cute babies.

I'm pretty sure no states is automatic - one has to prove it always. In my state, there's also a mathematical formula but it's just for displaying purposes to minimize liabilities of the court (like not informing the parties of possible alimony they are entitled to.) You hit the most important point - sometimes attorneys are not needed. But people tend to panic when it comes to legal process, and they always hire attorneys. Attorneys always escalate conflicts.
