Men wrote those laws. Men typically are the judges giving lenient sentences. In this instance you would be arguing that the *patriarchy* babies women; not society. A judge who is also mother is not going to go easy on a child killer- nor would an elected women writing laws about sentencing. women are less likely to be in these positions and statistically don't have much of an impact yet.
