I don’t know… if the opposing counsel said 50/50 during summer, then why not during school year? She will write emails denigrating me, but how can someone be a bad parent during the school year and a good parent during the summer? I will do homework. That’s no problem.

My lawyer isn’t saying enough that’s for sure. She is telling me that if the GAL is recommending it, this will likely be adopted by the judge. I have a previous email where my lawyer states that the GAL says 50/50 is possible, now my lawyer is saying I have to accept a temp plan…. How does a temp plan get put in place? Is it just signed off on by a judge before a trial? I will at least talk to another lawyer.

So I will have a settlement conference and my next hearing is in February. If that fails, do we officially get sent to mediation?

I haven’t either. Always had a roommate. Wife etc…. But make sure to get out and have human connection. Rebuild what you want to be in the future.

I am a little worried my lawyer is a settler. Both lawyers came away from a pretrial with very different interpretations of what the judge said.

My update is that I have a document saying 50/50 in the summer is agreed by the other party. The GAL does not recommend 50/50 during the school year. My lawyer thinks I can still fight to get 60/40 during the school year and that I should do that. As I said, weird system. Is there something I am missing? Child support will be reduced at 60/40 during the school year. What are we fighting over that I cannot see? Two kids, so we each claim one on our taxes.

I don’t understand this process. They say the GAL recommendations will weigh heavily. I should get that very soon. If it is 60/40, I guess I need to fight in mediation? That’s a weird system and it seems like it is just Illinois. I might get a step up plan, but the GAL says we are both fit and proper parents? I don’t get this system. The lawyers all suggested negotiating money vs 50/50 which is bizarre. Even the GAL mentioned it.

Yes. It is a bizarre process and in my area some trials can go 3-5 years. In my case there was a settlement proposal that is ridiculous. I feel that it has lengthened the case. Because now we might have a few more conferances.

Nothing…. We are living together at the moment. I’m in Illinois which is not 50/50. But close to 50/50. Such a weird state.

I am in Illinois too but have a much different case. SAHM do have advantages in getting parenting time, but it does not necessarily mean anything. If you are a fit parent, you should get time. The bigger question will be whether you can actually do the work such as picking kids up from school and extra curriculars. A judge may give you 60/40, but fight for 50/50.
