Agreed, but would you ever advise a client that it is ok to not pay alimony bc incarceration is unlikely? I doubt it, the threat & possibility are real.

In MD even if you have 50/50 custody child support can be ordered…. Thanks for your feedback, I’m on the fence about joining a firm but may end up going that route. The financial uncertainty of being a solo sucks but it does have a lot of upsides, and in 12-18 months I’ll have steady court-appointed work to supplement my cases, which will put me in a very stable financial position. The question is whether I can and should wait for that.

This is wrong, at least in the United States. You absolutely have to answer discovery requests truthfully and fully (no lying by omission) and most states I’ve seen have a requirement that parties file a financial statement with their initial pleadings that would involve disclosing assets/net worth. Fucking around in discovery and lying in court can lead to sanctions and contempt, in addition to ensuring you get completely screwed by the final ruling

Always find out what jurisdictions prospective lawyers are licensed in and research to see if they have a disciplinary record. Take a look at what they were disciplined for, if it was a lack of diligence or some form of deception move along. If they fucked up their IOLTA accounting or some other shit unrelated to their advocacy I wouldn’t be as concerned, but zero disciplinary history is always best.

Got it. I hope you can sort it out with him. Being a parent is the hardest job there is, we all do our best but still end up fucking up along the way. You sound like a good Dad and like you are coming from the right place, but like others I don’t agree with your approach and suggest you take some time to rethink it. Stay strong and best of luck.

Shop around for an attorney. You shouldn’t pay for a consult, you may be able to find a decent one who will do it for a flat fee, but the retainer amount they quoted you sounds reasonable (they vary based on your location/jurisdiction). You should definitely retain counsel if you can. Edit: I’ll qualify that I’m not suggesting you should divorce now, just that if you do decide to file you shouldn’t try to do it without an attorney.
