I wouldn’t move out and suck it up. It will hurt your case down the line and you’ll have no protection if she goes back on her word about custody. Leaving the house will give the impression that she’s the primary caregiver and the upper hand when the court looks at who they’re in the best interest to be with.

Works well for me. I got primary physical custody. Ask your lawyer for tie-breaking authority for your kids “education” and “health care” matters. These are the most important areas to the court and dictate where the kids live primarily. With tie breaking authority, you get to make the decisions on where they go to school and on health matters, IF you and your ex can’t agree on them.

IF full custody doesn’t work out, which in many cases aren’t likely with a fully capable mother, ask your lawyer to seek joint physical custody, with “tie-breaking authority” over Education. Tie breaking authority gives both parent custody but in areas where you don’t agree like where your child is educated - you get to break the tie. Not all states have it, but if yours does, ask your lawyer about it.

Like many have said, don’t move out. Start looking for a lawyer. And I’d suggest you identify everything in the house that are “must haves” that you don’t want to lose and covertly move them to somewhere that she doesn’t have access to (storage facility, etc). I had A LOT of things that I loved destroyed or “removed” by my ex that I never got back. Hide them now but document what you’ve moved when you get representation

I woke up one morning and my first thought was that I couldn’t do this anymore. I immediately walked into the kitchen, told her I was done, washed up and went to work. On the flip side, I secretly pushed her into filing first (several months later) to save money and prepare for my divorce case. Worked really well.

Hey, I'd negotiate on the fact that she can't afford it. I'd definitely take your crew's advice and secretly (or gently) remove all of your things (especially your must-have and like to have items). Hey, I've been there and I'd assume that everything she does is the mess with you or with ill intentions. Hopefully some of her actions aren't, but you should always be prepared. Hey, I agree again. Yes you can search the Internet endlessly to find some of what I wrote, but who has time for that. I, in 80 pages lays it all out for you and give you first hand tips on how I won. I would have paid $.30 to avoid my marriage too, but I didn’t. Dday_throwaway, thanks and I appreciate your opinions. I believe we make a lot of the same points, with the exception of when to get involved and to what degree. No divorce is the same and I used dating a little (not seriously) to clear my head and change my mindset as I worked through my divorce to a woman, to whom we both agreed was over. Start small and look for pockets of happiness. Going through it clouds everything you have going on. I call it mental plaque. Focus on remembering the things you still enjoy no matter how small or trivial they might seem. Try to do them as much as possible and build from there. This actually is a good thing. Buy some CustodyXChange software and track every single second you spend with your kids. Secretly build a case and gather as much evidence as possible and encourage her to continue. Use things like her social media posts to support her partying ways.
