Because Rape doesn't have to be violent.Black out drunk doesn't occur at a low level of blood alcohol. It starts happening to people once they get to about .2. Which is plenty to stop them from being able to think properly. Before you black out you're likely to start stumbling or having trouble standing, lose your ability to logically reason anything, become disoriented, and be very emotional and possibly belligerent. As far as telling goes, that might be a little difficult, but chances are they'll be showing at least a few signs that… | /r/MensRights | 23/11/13 06:42 PM
Because Rape doesn't have to be violent. No, regret doesn't mean rape I agree. But having sex with someone who is so drunk that they have no conscious idea what they are doing is. When you're that drunk you are in a state that any legal contact you sign is invalid because you weren't mentally competent when you signed it. Likewise when you're blackout drunk you don't have the mental competentcy to consent to sex. | /r/MensRights | 22/11/13 05:54 PM
Because Rape doesn't have to be violent.Rape is not a cut and dry crime. Just because something is rape doesn't mean that the participants have to go to jail. What I was trying to say about stopping it was poorly worded, I'm sorry. What I was intending to say was that the correct path to take is properly educating people about what rape actually is will prevent most rape from occurring, or at least most rape where someone feels like a victim. And just because someone feels they have been a victim doesn't mean the other person had to g… | /r/MensRights | 22/11/13 05:30 PM
Because Rape doesn't have to be violent. No I conflated drunkenness with having the mind of someone who shouldn't legally be allowed to make decisions, such as a child. | /r/MensRights | 22/11/13 05:18 PM
Because Rape doesn't have to be violent. They could give consent before they get drunk. they could also have an agreement that they can rape each other. You can have consensual nonconsent. Such as rape roleplay in the bedroom, where a couple agrees one will rape the other. It doesn't mean that they need to be prosecuted. Rapists' intoxication is already used against victims. I'm sure that person in the article had the thought that his rapist was drunk too so it couldn't have been rape, one of his reasons to think it was okay. Maybe thi… | /r/MensRights | 22/11/13 04:08 AM
Because Rape doesn't have to be violent. As a country we think that legal contacts don't count if you aren't mentally competent. Large quantities of alcohol make you Mentally incompetent: ex you get drunk and sell your house to me for beer money. So having sex with a blacked out drunk person could be likened to having sex with someone who has the mind of a child say below the iq of 60. Having sex with children is illegal, I don't know for a fact about mentally handicapped people, but I'm sure you'd agree with me that it doesn't seem ri… | /r/MensRights | 22/11/13 03:44 AM
Because Rape doesn't have to be violent. In that case neither of you would be having sex consensually. So yes you'd both be raping each other. I far as what legality would result from it I have no idea. Though id say your coercion would make you the one that gets prosecuted. You can't nullify the sex, just the fact that you both wanted or consented to it. | /r/MensRights | 22/11/13 03:33 AM
Because Rape doesn't have to be violent.Hypothetical: You're drunk, you just used the last of your money to buy drinks, and you're at a really high end place, so drinks are really expensive. In order to pay for your drinks I come along and say, I'll buy your house from you, you'll be able to cover all your drinks and I'll let you stay there rent free. You say sure! and sign away your house. In the United States, that thing that you signed is absolutely meaningless, you could go to a court with evidence that you were drunk and they wou… | /r/MensRights | 22/11/13 01:26 AM
Because Rape doesn't have to be violent. We charge people with robbing drunken people who walk down dark alleys. But it's their fault they got so drunk and got mugged right? So they shouldn't charge the people who rob them. | /r/MensRights | 22/11/13 01:20 AM
