Holy fucking shit, dude. He's a 16 year old child, she's an adult in a position of power over him. This is unbelievably wrong. If he didn't want to become involved with her, or wanted to stop his involvement, she could completely screw him over. If he reports it, no one will believe him or really care because of people like you that think it's "hot".

A person can commit rape while drunk. Being drunk or otherwise chemically imparied does not excuse a crime.

The whole thing is a bucket of worms. You can't excuse a person for drinking themselves dumb and making a bad decision, but it happens. That certainly doesn't excuse the fact that he had sex, but clearly did not want to. He did, and maybe he did consent, but probably only because he was impaired. Again, doesn't make it right, but it happened. Turn it around and what have you got? A guy goes to a party, finds a girl who is absolutely smashed, talks her into having sex with him or obtains some shred of a consent, then does the deed. Is he a rapist? Yes, absolutely. That guy is a sexual predator preying on people who are unable to properly consent. The fact that the woman had to go after him after he was already unable to make a legitimate consent only furthers the implication that she was a predator. He was raped whether he said yes or not.

Now whether she was drunk or not becomes null because she recalls everything. The approach, the consent, all the gory details. Therefore she was not nearly as impaired as he obviously was, passing out with his eyes rolling around. Even if she was drinking, it doesn't excuse her behavior.

They could give consent before they get drunk. they could also have an agreement that they can rape each other. You can have consensual nonconsent. Such as rape roleplay in the bedroom, where a couple agrees one will rape the other. It doesn't mean that they need to be prosecuted.

Rapists' intoxication is already used against victims. I'm sure that person in the article had the thought that his rapist was drunk too so it couldn't have been rape, one of his reasons to think it was okay.

Maybe this is cynical but rape happens, it probably will for thousands of years. The idea is to spread information to reduce it, because clearly the victim in the article was in fact a victim according to his symptoms. But not everyone that is involved in rape is a victim, some people are perfectly fine afterwords, like a husband or wife who blacks out but still had sex with their partner. Or someone who ends up having sex, with someone they would have wanted to sober, at a party while blacked out drunk. And then they start a proper relationship with a lot of consensual sex. It doesn't always have to result in a traumatic experience for the pain who was raped. but it often does and those are the ones to prevent. You just can't stop one without stopping the other.

Well, we don't know exactly how drunk she was, maybe she was also drunk to consent by the standards of the "it was rape" proponents here. And then we ought to prosecute him.

But not everyone that is involved in rape is a victim, some people are perfectly fine afterwords, like a husband or wife who blacks out but still had sex with their partner.

However the victim feels, if it was a rape by our standards it has to be prosecuted and carry a severe punishment.

It doesn't always have to result in a traumatic experience for the pain who was raped. but it often does and those are the ones to prevent. You just can't stop one without stopping the other.

So you are OK to put some people who have done no harm in prison, to protect people from their drunk choices? I thought in a state with rule of law not punishing the innocent takes priority over punishing the guilty.

Black out drunk doesn't occur at a low level of blood alcohol. It starts happening to people once they get to about .2. Which is plenty to stop them from being able to think properly. Before you black out you're likely to start stumbling or having trouble standing, lose your ability to logically reason anything, become disoriented, and be very emotional and possibly belligerent.

As far as telling goes, that might be a little difficult, but chances are they'll be showing at least a few signs that they're very drunk. But even if you couldn't tell, that doesn't make it okay that it happened. Accidentally robbing someone is still robbing someone.

So yes you'd both be raping each other. I far as what legality would result from it I have no idea.

If you want use rape in a different sense than the legal one, that's fine, but the article at xojane as well as my comments refer to the crime of rape.

Though id say your coercion would make you the one that gets prosecuted.

Every rape should be prosecuted. And the kicker is in the scenario I described it is likely that I would be able to make the case plausible that I was too drunk to consent, for example because other people saw me drinking a big amount of alcohol and acting drunk, while she doesn't have more than her words to prove the threats I uttered when the two of us were alone.
Sure, in this case the sexism of the legal system might save her, but imagine my scenario with the genders switched, a drunk woman coercing a man through threats into sex and then preventively going to the police to claim he raped her, because she was to drunk to consent. If we accept, that one can be too drunk to consent, but not too drunk to be able to rape somebody, the result might well be, that the man, the bactual victim would be convicted of rape (and then once incarcerated raped again). This is a perversion of justice.
