Don't do anything without legal advice and a court order allowing it.

Wait for the divorce to be final before you reveal everything

Scorched earth after the divorce is final Cheaters and their apologists will give advice to stay out of it and say nothing.

You can easily verify it by searching your state's divorce laws. Default depends on the judge.

Your attorney waits until the response time has elapsed then files for default

It sounds like a good deal. California will send you through the ringer otherwise. You're right about dating though. It'll be VERY hard to find someone that's ok with it. I would take definite financial security over the possibility of dating.

Some people make these out to be special relationship things. If you don't feel attending a wedding is special, make sure you talk to her about it before going. Otherwise, go and have a good time like it's just another date

Frankly, it's weird to even consider it without knowing anything about him You can't do anything even if you find something unless it's SA on a minor

It's uncontested until you don't show up for court. You need to show up

Every state requires that you be a resident to file annulment and divorce. Timeframes are different
/r/Divorce_Men02/09/24 04:24 PM

Both of my comments that you replied to said you have to be a resident to file
/r/Divorce_Men02/09/24 04:14 PM

There's actually a couple states that are longer. Arkansas and Connecticut are 18 months... Yikes
/r/Divorce_Men02/09/24 04:14 PM

That qualifies for annulment in California but you need to live there to file. No minimum residency required for annulment.

Not in North Carolina. You have to wait that year of physical separation. You can't file in a state that you are not a resident. Some states have really short residency requirements. Nevada is 6 weeks.

I can't find anything online about a 2 year wait in the UK. Divorce laws were changed in 2022. Talk to a lawyer.

An attorney is not required but advisable

I did for my first divorce. Typed up a fair split of everything, got it notarized, and submitted with the petition. Official less than 3 months later

I deleted every pic she was in and did a search to delete every comment she made on my stuff. It took me a few hours and I'm still finding stray comments that didn't get found in the initial search

Try the legaladvice sub or talk to a lawyer

You have to get the case jurisdiction moved to your new county then file for updated custody

If you can't find a lawyer by Thurs, go to the hearing and tell the judge you haven't been able to secure a lawyer. He'll set another hearing date in a few weeks or more.

There were many times she got drunk and wanted to "talk" (start an argument). Grey rock and stoicism. I got really good at it lol Gaming and new Discord friends kept the days going by real fast. I had no local friends.

I did it for 2 years. It sucked! We didn't have kids so it was easy to isolate myself in my own room.

Good on you for keeping sober! I started a journal to write in when I was spiraling. Digital and locked in my phone. Might help you

You don't have to close the account. Just get your name taken off it after you remove your money.

She's moved out with the intention to divorce. It won't matter unless your state has very specific laws on it. In North Carolina, living separately with the intention to divorce eliminates these actions as infidelity.

If it doesn't get sold, it's still half yours and your responsibility. You should be able to put the negative equity into the divorce calculation for assets&debts and he can take it over completely with your name being removed from the debt/deed.

You file where you live or where she lives. Check Arizona law in regards to the respondent not being an Arizona resident. If it says she must be a resident, then you would file in Georgia.
/r/Divorce_Men12/10/23 01:43 AM

Your real equity is only 11.6%. Which means her half is about $19K after selling costs and repairs, if you were to sell.
/r/Divorce_Men27/09/23 03:43 PM

How much do you currently owe? How much is it worth? Say your house is worth $300K. It takes 8% of that worth to sell the house. So, you would only get $276K on the back end. Is your mortgage loan more than 92% of the home value? If so, there's nothing to split.

Nothing wrong with dating. Just be upfront with marriage and, if applicable, living together are off the table.

I had similar issues. 3-5 hrs per night for about 6 months. Occasional crash for 12 hours maybe once every 3 weeks. I went to a couple counseling sessions and the counselor recommended that I start a journal. Any time I had a build of negative thoughts to enter it all into my journal. I haven't had a sleepless night since. It may or may not work but it's definitely worth a try.

It's more like guidelines than actual rules. As long as your STBXW knows you are getting divorced, live your life the way you want. For some, hook ups help the transition and, for others, it hinders their progress. You won't know until you get in the situation and see how it affects you.

Your previous post was as a woman in the military that's not married, has no kids, and no ex-boyfriend to worry about. You also said that having male friends isn't good for dating. Now, you're a divorced man with kids trying to start a long distance relationship? Make this make sense

Nothing is frozen unless one of you requests a judge to issue an order to do so. A second TSP loan cannot be taken until the first loan is satisfied. She also cannot take a loan without your signature on the loan request form. However, it's not a notarized form and the TSP doesn't make an effort to verify it's the spouses signature. Any loans taken prior to legal separation are marital debt and the responsibility of both of you.
/r/Divorce_Men19/03/23 04:29 PM

She can take a loan up to 50K to pay you after the divorce is granted.
/r/Divorce_Men19/03/23 03:39 PM

If your previous post about $100K in debt is still accurate, it's likely you will both end up with nothing and have to sell everything then split the remaining debt.

Your lawyer can file for default but it'll make you look better for providing another copy since she lost the first one. Make sure you text her as such to prove you provided a second copy.

You can get a court order at any time with the right argument. Her moving out doesn't mean the kids have to move out.
/r/Divorce_Men28/02/23 01:08 AM

If she's not on the deed, he needs to move back in and get a court order to force her to move out. It was illegal for her to change the locks without his permission.

I developed a type of self therapy where I go into my Facebook memories and delete any comments and posts having to do with my ex. I deleted all IG content with her the first day because it's a lot easier.

Ask a lawyer if you can secure your half of the equity in a trust for your son. That way if she decides to sell the house, half the money will go into a trust for him.

Why on earth would you give her nearly $200K???

Does your state require a year of physical separation to grant a divorce? Does she have the ability to get a restraining order? If the answer is "No" to both of these questions, it's only a matter of if you can cohabitate until the divorce is granted.

We're both in NC. I'm going to be living in an RV trailer on a rented parcel. Might be worth looking into if there's availability in your area.

I'm in the same boat as you. To top it off, I've browsed through the dating apps for a large age range (±10 years) and maybe 2% of the women within 40 miles are my type. Rural areas suck for prospects but I won't start to try to date for six months at a minimum.

Not likely if she's convicted of a crime. You can also send a notarized letter detailing the things you have suffered if you know her GC#.

I can't even afford to move out. I also have no interest in running a bar. She's been a bartender/bar manager for 20 years. She's really good at it. I wish she could buy me out so I can move on with my life and make her non-existent to me.

No alimony here with infidelity.

I haven't drank since Nov. I needed a night off from my solitude in my room. It's exceedingly rare that I reminisce on anything. I prefer to live in the moment and consider what might be but not to the point where it affects my day-to-day.

There was no major malfunction in my first marriage. We grew apart over 10 years, split amicably, and coparent very well.

I already have video and picture evidence of the cheating.

I don't put any money in the bar. It does enough business to pay for itself and the loan payment. Bankruptcy is not an option. It heavily affects my career. The only asset I have is the house that we would both have to sign to sell and she refuses. Can't get a court order without a divorce proceeding.
/r/Divorce_Men30/01/23 05:29 PM

All I have is the proof of the cheating. Her family wouldn't be able to help her financially. The bar is self-sufficient but not enough to pay her personal bills due to the loan payment.

It was an amicable split. We just grew apart after 10 years. We coparent very well.

It sounds like you had a shit lawyer. My supervisor finalized his divorce a couple months ago. His ex cheated and she got hammered by the judge. No alimony. No retirement. No equity from the home.

§ 50-6. Divorce after separation of one year on application of either party. Marriages may be dissolved and the parties thereto divorced from the bonds of matrimony on the application of either party, if and when the husband and wife have lived separate and apart for one year, and the plaintiff or defendant in the suit for divorce has resided in the State for a period of six months. The only good thing about NC divorce law is that adultery eliminates alimony and can push property division heavil…

I talked to a lawyer before I told her I knew. There are no waivers for the 1 year separation period. If I move out, she leaves and I would have to continue paying all the bills and the loan for a year before I can get in front of a judge.
