It's not illegal to use as evidence, it just won't normally be used by the court to identify a private individual. This act is illegal in several European countries but falls under 'sexual assault' or 'unlawful sexual contact' type of thing, rather than rape. Can confirm: Saw a guy with ASD get raked over the coals after two women said he 'looked' at their "chests".
