Ok lived at the same address. Check with tax professional as the IRS will see that 2 people are filing seperate returns from the same address and may ask you questions: in an audit. Typically, married failing seperate requires that you add the name of the spouse and their social security number. Filling single with the same address rising a red flag. If. You are seperated and one person files itemized, then the other is compelled to also file an itemized return. Check IRS rules on that as stuff changes. Most likely file single if you have no dependents.

No. My BIL did exactly that and end the end he regained his house back and his children were and remain around him and his family. He is now on his second marriage that he didn't rush into and has a couple of young children with a virtuous wife. His life is bliss. His friends sometimes thought he was too nice during the divorce giving the ex everything, but he did it for his children and he has maintained a happy household, minus the ex. Stop the drama reiterating that you want a divorce. Compel your lawyer to do their job. Perhaps they are moving slow because you are sending mixed signals. Do you really have to move before the lease? Don't rush the move out as you have a 2 year old. Really take all the time you need to figure out your living situation after the lease and in the meantime, build a tribe of support within your current area. Resist dating as long as you can while you share the leased house. Just some thoughts but do seek legal guidance to fully understand what lays ahead. OP if you put the interest of your 3 year old first and foremost, then you will be able to make the right decision. Do make INFORMED decisions.
