I'm not sure why moving out of the house unless compelled to do so by a judge is even on the table. You stay there as long as possible. She can move out if she wants to get a divorce.

You don't steal alimony from your spouse period. Doesn't matter what gender you are, it'd morally wrong. You make it on your own. What's legal and what's morally right are 2 different things. Now, only being married 3 years, then asking for alimony, he'd really come off as a loser leach. Same thing I'd say to a woman.

Make sure to ask the court for your lawyer fees since she is the cause of you needing to get one. I made sure our agreement had a clause in it that any party who trys to go back on the agreement will be found liable for the other party's lawyer fres to defend the original agreement.

I live in Wisconsin and did this. It held up. All I owed her was 30% of the equity in my house, nothing else. Saved my a few hundred thousand. I did get her to draft the postnuptial agreement though, which I think went a long way. She not only drafted it, but also scheduled the notary. Being as this was now her contract, I think that helped a lot. Just put some pressure on her to draft up the contract since she is the cheater.

Yeah, but you don't have to be that in the future. You can get the child support and alimony, that'll probably be an extra few thousand a month, and with your teachers salary, have a pretty solid non-poor life. Your best bet is to probably hire a lawyer and never talk to her again, so she can't manipulate you during the negotiations.

Since she doesn't know you eant a divorce yet, and doesn't know you know about the affair, you could try to approach her with the idea of a postnup agreement. Technically you can't do one if you plan on getting divorced, so keep that on the dl. I was able to get my ex to sign one and avoided spousal support, taking on her debts, or splitting any property that was mine, cars, bank accounts, 401k, stocks, etc. Basically a what's mine is mine, what's yours is yours, what's ours is ours agreement

She's already seeing someone, probably that married guy she supposedly stopped talking to. She just wants you on the bench of the affair doesn't work out. Why make it easy on her and move out? She's the cheater here, not you, so tell her she can move out. Plus, you don't want to leave your kids. Lastly, I'd normally not promote going for 1/2 of everything, including her retirement, but since she is the one who stepped out on the marriage, please do. Unless you had a prenup, I'm pretty sure you might be entitled to 50% of the equity. Since you were married, even though she paid for the upgrades to the house, you may actually owe none of that. I have no clue how WA works, but definetely get a lawyer. It sounds like they are trying to take advatage of someone who is unrepresented.

My wife left for someone else back in 2023. I then allowed her to move back home when her mother conviced her she was making a mistake. During that time, which only lasted a few weeks before she removed back in with him, I was able to get a post nuptial in place that saved my big time. Good luck getting one, sometimes an opportunity will emerge and if it does, take advantage of it.

As long as once the kids are out you can sell the house and collect your 50% of the equity, nothing wrong with what you are doing. Just don't give up your equity when the times come. In the end, you might even make more money doing this, if home prices keep going up

I got lucky and somehow got my ex wife to sign a postnup a few months before I filed for divorce (I didn't want a divorce, but she was mentally unstable and I saw it coming). This saved me hundreds of thousands in my divorce. I would never again risk it, I will for sure get a prenup if I ever am dumb enough to marry again. Got lucky once, wouldn't count on it a second time.
