OP...listen to this guy. I wish someone would have told me this a long time ago to avoid this. ITS DEVISTATING and apparently way way too common to the point where I cannot believe there haven't been protections put in place for shit like this. Unbelievable.

This appearance is going to make a huge impact on the rest of your life. Come well dressed and groomed. Please by all means, if you have piercings, dump them...and not just for the court...for good. Shut the fuck up as much as you can and when you do have to talk, make the words count. This is not Maury either...whatever you say, make it relevant and make it count. I have been there and will be there again with you soon. Good luck.

Getting your stuff from the house will be real tough then. Also, it will be a lot of fun grabbing your own property from your own property under police escort while your neighbors all watch. What a joke of a system. I had to buy a new suit so I could get a court order to get my suit for court. smh.

In CA, once a divorce is initiated, there is a standard restraining order that applies to both parties about various things. One of them is out of state travel…no can do. Not a lawyer and not sure what state you are in but I think it’s common.

You may also be on the hook for rent as well though (Watts/Epstein). If she owns half the house, she maybe entitled to half the rental value (not mortgage rate) while you are occupying it. If the rental value is higher than the mortgage amount you are paying, which it likely is, she may be entitled to half of the difference. I don't think the utilities apply since you are consuming those by yourself. I am no lawyer, so I may be way off but you can do a little Googling.

My Ex wife got a lot of money that the law says she was entitled to, but in reality...she never contributed to. It was money I earned despite her pulling time and resources away from my job and towards her during marriage. For me, I feel that if I didn't contribute in earning it, then I wouldn't want it. I can make my own money, I don't need anything from a woman. To each their own though.

Similar situation. The court will remember her play with the DV charges. It doesn't change much because the law is the law and she will still get a chunk out of you but they know. Speaking of your chunk...if you owned the house before marriage then you could be entitled to the majority of the equity. Look up Moore/Marsden. That is how they calculate that. Also, if she is occupying your property while you are paying for it, you could be entitled to compensation for that. Look up Watts/Epstein. Go…

Yes it was worth it. I filed, not because I wanted to, but I had to. Her behavior was getting worse and worse to the point where it was going to destroy everything. I had initial regrets when I first left but as soon as she was served with the papers, she completely justified my fears and went full nuclear. Fortunately, I was clear of ground zero then and only had to deal with the collateral damage. I made the decision...but I didn't have a choice. It's been an awful experience, the worst of my …

Tell her "No". She will then have to take you to court to get permission and you will not lose unless your Judge had a stroke the day before trial.

Deduct it from her payments later and let her take you to court? Claim the children first next year right on April 15th? Eat it and move on? Also, it's more likely that your CPA was talked into it rather than visa versa...unless he was trying get in her pants if it is a "He". If's it's a "she" then we all know what happened there.

Look up Moores Marsden law and see if it applies in your state. It calculates interest in a home that was pre-marital. Because you had equity in your house before marriage, the gained equity after marriage is proportional so it's not automatically just 50% from that date. Your refi and trust may change all that but I am not sure. Talk with your lawyer and they should be able to punch those numbers up for you. If it is the law in your state and if you have the proper documentation, it shouldn't b…

My Ex definitely poisoned the well at my kids school. I walked in there like I was the devil. I tried to over compensate for a bit but realized that it doesn't really matter so I was just myself and didn't try to make my case for them. Eventually, they seemed to understand and even accommodate me with separate communications since I was not getting any information passed on to me by the ex. Also the neighbors. She had me removed from my own house that I owned before marriage by police with false…

Certainly not ideal but they will adapt. They may like certain things about one home and certain things about the other. My kids have to do it and they are young but they seem to be excited about coming home and also happy to see their mom. They're young and we are their main social structure right now. As they get older with friends, that may be a little more tricky to accommodate because that will be their main social structure. Just adapt as they have to knowing that it's not an ideal situati…

You won't get more than 50/50 unless she is a dangerous crack whore, and you shouldn't. Prove your case against her allegations. This is not the first time a Judge has heard false allegations, maybe not even the first time that day. Hopefully the court will see right through it. Prove your worth as a father and get your kids...they need their father as much as their mother.
/r/Divorce_Men23/05/23 09:49 PM

You will have to take on some of the roles that your ex did when the kids are with you but it's not quantum physics, you will learn. The interesting part isn't that it's just the mechanics and logistics, but how you nurture too. You will have to also be a bit of a mother during your time as well. You can handle it. Don't listen to your wife. Go get your kids, they need you.

My ex got an ambulance chaser...I really wish she just got a pro. If she did, this divorce would be settled and I we would both have more money in our pockets. Careful what you wish for.

Talk to your lawyer and get a court date now. The longer you wait, the harder it's going to be. If she won't let you see your kids then it's time to make her through the court.

Just because you aren't there anymore doesn't mean she cannot make shit up from the past. Her lies were full of holes because they were complete fabrications so they weren't hard to disprove. Still cost thousands of dollars, stripped constitutional rights, wasn't able to see my kids for three weeks...it was horrific and it was all lies. No consequence for her though. It's amazing that those tactics, considering how common and devastating they are can still be legal.

There was a thread the other day on there where a dude talked about how his wife showed him a bunch of Tiktok videos reinforcing her plight about her decision to leave him. He tried to be neutral and mention some of his short comings which were relatively mild. He got absolutely roasted. You're a grown ass man. Fire your lawyer, get a good one and fight for your kids. This shit happens to a lot of men...some kill themselves, some roll over, and some fight. It's an uphill battle but it's conquerable. I had a similar situation as you. I have my house back and my kids 50/50. My kids are happy and thriving with their dad...yours can too. Look up Moores Marsden. There are calculators online that you should be able to plug into to determine her share. Likely if it was all paid off...there is little, if any she is entitled to.

Happened to me too. I had a good case against her TRO (ie actual evidence unlike hers which was just spewing hate) but agreed to a pendante-lite order at court for her to drop it so we could all just move on (Kids). BIG MISTAKE. What I thought was going to be two months temp order turned to be 9 months of me being not allowed in my own house (Sole property) while I still paid for everything! Been an uphill battle ever since. DONT DO IT GUYS. Fight and win to get back to equal footing. These TROs…

If they are still saying "Mommy" then they're probably young. They are going through a lot and emotions are all over the place. That does not necessarily mean that they are actually afraid of their mother. They could be saying that to her about you too. Saturdays seem like a bad time for an exchange. It ruins either parents out of town plans with or without the kid for one. Can you perhaps change it to a weekday morning? My STBXW asked that we wait a year before overnights during court ordered mediation. Keep in mind I raised the kids with her everyday just prior to the false TRO that were squashed. Anyway, our mediator knew it was ridiculous and I imagine she told her (Separate rooms). I thanked the Mediators for their time and we were in court later in the week. I'm in the midst of it and certainly feel the lack of focus at work. It probably doesn't help that I am posting on Reddit during work. I can maintain and get my work done, but when confronted with real heavy lifting and complex work, I stall and procrastinate. I just can't settle into that that focus mode as often. It's getting better though. The ironic thing is that being able to sink my teeth into my work was one of the things I used to look forward to while contemplating divorce.

When is your court date? Mine was three weeks (of misery) from service. I fought it and will have 50/50 soon. The TRO was effective and I did lose a lot of ground though...I am still clawing my way back. DO NOT AGREE to a shitty deal if she offers to drop it. Wondering what your lawyer said about going after her about the false TRO. I got one that was a lie whole cloth. I had good evidence and the judge warned her to drop it and she did.
