Wow that's awful man! How did you lose everything in the divorce though? Isn't the max she can take 50% of marital assets? I totally agree on the lawyer thought. The moment they encourage her to go after everything she will feel justified and go for it. This is a pretty tough situation. It's likes I'm at her mercy.

It sounds like since we are filing together they would be most likely to agree with our settlement, but could step in if they feels it unfair. At this point I'm trying to see if there's any way to protect the additional money should could go after.

Yeah, I'm trying to approach this very delicately. I agree, the moment a lawyer gets involved they are going to tell her to go for it all. Lately she's been saying she wants a mediator. So maybe I can bring them on ($300/hr) to appease her.

I mean sadly this seems like the best idea so far even after calling around for some lawyers. Apparently, there isn't a way to safeguard my additional money (the amount she could technically go after) beyond what we verbally agreed to.

Alright, I called a couple attorneys and one mentioned doing the initial filing and drafting a settlement for an hourly rate (sounds like it would be under $1k, I believe they called it a cr2, some unique form they have for the court that's unique for lawyers) as our marriage is pretty straightforward. So far I was able to mark no alimony requested on the initial filing, so that seems like a win that she agreed to that and signed off. Now it's just a matter of creating a findings of fact and conclusion document that outlines how we will split everything up and get her to sign off. My biggest concern is the judge might reject the approach and perhaps talk her into going after more.

Well the file now was based on advice I've seen here about getting the initial filing done immediately, otherwise the clock keeps ticking (we are still under 5 years which I believe plays a role). What difference does it make if we just create the settlement ourselves for the 50k and sign off vs a lawyer doing it? Plus, for it to be valid from the lawyer don't we have to get the lawyer to draft it, then pay another lawyer to review it with her, then sign off? Is it possible the judge could overr…

Yeah, it sure seems that way, but really we had a lot of issues and just arnt compatible. We have zero debt and no property. Is there anyway to protect the money I made during the marriage? I'm just worried this initial $50k she mentioned will magically change into $150k request. I'm hoping right now there will be no attorney fees, but who knows at this point. Yes, I think it's a fair amount. It's effectively what she would have made had she kept her job back at home and some extra. I don't have any disdain toward her and I'm hoping we can agree on this in the end, but like you said things can easily change. So I'm trying to see if there's a way to somehow protect myself in the situation she decides to go after more despite having these initial conversations.

What if we both agree on the "buy out" lump sum amount beforehand? Can we just go in with an uncontested divorce and outline that in the divorce settlement? Or will the judge refuse to approve it if they feel it's "unfair"?

I agree, part of the no job aspect was going through the citizenship process which didn't make this easy (e.g. delayed green card), but even following this she still was reluctant. I made sure to cover all cost and expenses during our marriage.. basically anything she asked for I would cover within reason.
