She's keeping the kids with no rightAnytime. You know technically because there is no order you could pick the kids up from school. Obviously ask your attorney, but man the pain and suffering I went through totally worth it for my kids good luck! | /r/Divorce_Men | 19/01/26 05:16 AM
She's keeping the kids with no rightSorry for your suffering. If you’re spending that much and still early in the process make sure they have a clear strategy. Custody in CA is straightforward 50/50 unless abuse or substances are involved. It might be a while because of courts. Make sure you have a date my court dates were sometimes six months out. When my ex was withholding kids without order I visited them at school upon dismissal. I know it sucks but it is not forever I can promise you that. Rant whenever you need. | /r/Divorce_Men | 19/01/26 04:36 AM
Husband wants a divorce, I'm 32 F with three kids, am I dateable after this?I’m sorry this is happening. Everyone is datable after a divorce. For me I was not in the right place for several years. I focused on myself and became a better person. I am raising a 2 & 6 yo and have a high demanding job but find time. Friends and partners enjoy the company of interesting and nice people. My focus on my kids has lead me to meet other like minded individuals that I never would have met in my previous life. It took a while, years, as the divorce process for men is a very differe… | /r/Divorce_Men | 29/08/25 02:42 AM
Should I hire the lawyer?Yes! Even if you agree on everything they can give you perspective. Ask your counsel what they think reasonable is and what they’ve seen in similar situations. Early on you will feel wronged and shafted but in the long run as long as alimony is reasonable it will be significantly cheaper IMO. Court not only cost a lot but it flairs tempers and rationality which drag things out. Also Court is not fair and there are no winners, both sides share shitty rushed decisions. For me going to Court is min… | /r/Divorce_Men | 25/08/25 04:11 PM
Loosing hopeKeep fighting, keep documenting and focus on the kids. If you’re worried about your kids and if she is offering drugs call child protective services they are required (in my state at least) to investigate. It will get better I promise. Honestly my life after the court BS which took years has been great. You’ll get there, just focus on the kids and take solace in many others have | /r/Divorce_Men | 29/06/25 01:34 AM
My wife moved out with the kids today without informing where. I was informed by a neighbor asking if it was normal a moving truck was emptying our house.Second this. Do not cheap out not only could this cost more but it can take years to undo depending on what is allowed to happen. You need an emergency order now, as in this week. It can happen, hire an attorney to help. An emergency order will provide time and stop her from changing the situation. | /r/Divorce_Men | 24/06/25 10:00 PM
Lying in Family CourtYep sounds familiar. My advice is don’t lie, if you’re caught you’ll be fucked. After all you’re a man you living up to the stereotype. At least where I’m at mostly women and specifically single divorced women run the social Worker aspect of the court. | /r/Divorce_Men | 06/02/25 07:31 AM
Wife filed TRO, judged denied the request to evict me from the house, but still have to do supervised visits.... in my own house.I’ve been there too. If there is not an order against this I would setup a video to record everything for the next seven weeks. It sounds extreme but your word against another’s isn’t going to fly. You’ve already been told “out of an abundance of caution “ line. Be prepared to back everything up. It is a war until You turn the corner | /r/Divorce_Men | 20/03/23 06:07 PM
Stbx employment questionI clarified a few statements and added make sure your attorney has a plan. Cannot stress that enough. It is possible to get mistakes corrected in Court but it is expensive, slow and a lot of work. Good luck | /r/Divorce_Men | 15/03/23 09:13 PM
Stbx employment questionNot sure why you're being down voted. What you said makes sense for me and is fair. But what you NEED to establish in the Courts is her capacity to earn. That capacity will be used in any calculation to determine whether YOU need to pay her. If the Courts decide that she needs to pay you, you can either accept the order and not enforce it or in Court reach an agreement with her that you do not need/want financial support. The latter would be tough to change if in the future as you would need to … | /r/Divorce_Men | 15/03/23 05:33 PM
A week ago, She left and took my 2y/o autistic son and filed a no contact/restraining or against Me and moved into her moms. She hasn’t filed for divorce yet, what does that mean? You don’t need an attorney for the full divorce. But you do need one starting TRO hearing and to help you get your filings in. If you get ahead you can reevaluate. Call three and be point blank and lay everything out and ask what their plan is. This is not an uncommon scenario an experienced attorney will have a clear plan of attack. Trust me if you mess up here it is only more expensive and longer battle for you. I made that mistake. Good luck 👍 | /r/Divorce_Men | 08/02/23 06:18 AM
child support fair amount???This 100%. This is a Hail Mary. They don’t expect you to sign it but it’s lawyer work to make you feel little and overwhelmed. Child support in general is a clear calculation. Get an attorney to help you walk through this. Lawyers are expensive but not getting one is even more expensive. Trust all of us when I say this. Good luck | /r/Divorce_Men | 17/12/22 04:23 AM
I am currently starting over in life and would like advice.Like others said you are young. You will bounce back from this. Trust me like others have said you will look back in 5 years and realize you’re in a better spot. Use this time to make yourself a better person. Now with what you are giving her: the car and apartment no big deal. The car is a hit but again in time you’ll work around this and get another one. About custody, PLEASE SPEAK TO A LAWYER. This is something if you cede willingly maybe very difficult and expensive to get back. The lawyer m… | /r/Divorce_Men | 29/11/22 07:41 AM
My wife realizes she is going to lose the divorce she filed for. Can she withdraw it?I am following up on your comment here. You’re heart is in the right place. I commend you for being the bigger person and to not act malicious. You don’t want to ruin her life but bring success to your children. If she resents you, that is telling for who you married. My ex is the type who will never date again and put all her energy into legal fights. If your ex-thought she could move away with the kids she is delusional. Unless you are a true piece of work this is unlikely. You have joint cust… | /r/Divorce_Men | 31/10/22 07:08 PM
My wife realizes she is going to lose the divorce she filed for. Can she withdraw it?If she messed up I would say don’t give her an out. Would she offer this to you? If you have the upper hand don’t cede it. From what you written you only stand to lose or at a minimum take unnecessary risk. Of course talk with a lawyer. But even if court cost more if you have a higher chance of victory stay the course. | /r/Divorce_Men | 31/10/22 03:10 PM
it keeps getting worse...This. No favors. Not one. You are at war | /r/Divorce_Men | 06/06/22 10:08 PM
What If You’re Doing Better Than You Think?Best advice I’ve seen in a long time. Definitely a lot truth behind this. For those of you out there who are down. It will get better. | /r/Divorce_Men | 28/04/22 10:37 PM
Arguing with you in front of the kids...This evening it cannot be used later. It will be helpful for your attorney if you capture anything important. If you don’t feel comfortable making a secret recording keep a log of all incidents. It sucks but it will help if you need it. | /r/Divorce_Men | 15/04/22 12:20 AM

I hired a layer Jan 6 for a no contest divorce and now we are almost in March and still, paperwork is not ready for my wife and I to sign. Is this normal or should I hire another lawyer? If you are waiting for your attorney to file out the paper this long this is strange. Particularly since it is no contest, this should be boiler plate stuff. Like a few hours of paralegal work and several for the attorney to read over and approve. I thing you should find someone else. You could also likely complete yourself if you have the time and discipline to read through. | /r/Divorce_Men | 20/02/22 05:51 AM
Divorce and Young KidsThe young kid thing with 50/50 is really only <2yr (at least in my county in CA). The best advice I have heard is to: 1) Make a plan, establish a status quo 2) If you think custody battle is on the horizon, file first with the courts Talk to multiple lawyers. Where I live 50/50 is the norm unless their are allegations of some kind of misconduct. I made the mistake of trying to work things out and am fight for more time. The issue I'm finding with getting 50/50 is not so much that I will not get … | /r/Divorce_Men | 02/02/22 12:58 AM

What happens when you file?I believe (I may be incorrect) but only vested and realized securities can be counted as income. In the discovery portion of the divorce she can ask just about any questions including your income and all compensation details. This however would be something an attorney would know exactly what you can do. | /r/Divorce_Men | 05/09/21 02:38 PM
What happens when you file?Commenting on your question about freezing of assets. This applies only to “community” assets. Typically anything of value collected during marriage. Once you have “separated”, this date is defined as when one party informs another that they are filing for divorce. This can be a date before you file. Anything you earn after the date of separation is yours free and clear with the exception that the income will be used in alimony and support calculations. I believe in CA they say there is a “restr… | /r/Divorce_Men | 03/09/21 09:32 PM
[California] Will I get 50:50 joint custody of our children? No problem if you have specific questions PM me. If you are in my area of CA perhaps I could give you more pointed advice. | /r/Divorce_Men | 06/07/21 10:12 PM
[California] Will I get 50:50 joint custody of our children?Get a lawyer ASAP and file for divorce assuming you have been separated for the six month cooling down period the CA requires. The good news is family law in CA is based on "best interest of the child" and it has been established that 50/50 is the goal in CA. 50/50 is only not a guarantee if there are substance or domestic violence allegations. The key word is allegations, which is why it is important to file first for divorce and get your story out to the court on your terms. If she throws alle… | /r/Divorce_Men | 06/07/21 08:23 PM
Financial DeclarationsThis is true. Anything made after the date of separation is each parties. In my case, EVERYTHING needed to be disclosed. However when determining support anything they make, including gifts, loans, windfalls can be considered when determining alimony and child support. | /r/Divorce_Men | 23/05/21 09:15 PM
Lawyer feeThis so much. Your lawyer and you are a partnership. You need to have one that you are comfortable working with. you should g with your gut. There are many styles of lawyers just like people. If you are not comfortable after five consultations then it does not sound like it is a fit. You can have a lawyer who is great at law but not the best lawyer for your situation. I.e. they are slow, more disorganized than you are comfortable with, or generally file things last minute, maybe they do not have… | /r/Divorce_Men | 10/05/21 08:26 PM
