The only thing I can think of is asking for more than 50% of the home equity because they have no money and rely on their elderly parents to live. Good luck getting her to write a check for anything. Some of my retirement contributions and gains were pre-marriage. But at the current rate (15k for two attorneys since this involves separate states for assets and custody) even then there's not going to be a lot left in this IRA. My pension is not a big target either. However they have similar accounts that I could be asking for half of since they were setup during the marriage. I mean lawyers are going to get a lot. They are also coming counting on a sum of my retirement. But it wouldn't be more than the house equity. For me I just thought I would get as much as I could and restart fresh to pay myself back. Alimony is questionable given the length of the marriage is 4 years. If I ask for say that 100k she has to pay me, but I am paying her child support. I am not expecting that back because I make more and don't need it. If one stays the other buys the others equity or refinances half the mortgage onto the existing mortgage? It's really hard to know if it's better to stay or sell with so much money up in the air. If I can afford to stay, should I stay. I could use what I would get in the split to buy their half, depending on the amount.
