The bona fide occupational qualification wouldnt apply. The driver is not examing the patrons sex organ. Certain races are responsible for more crime, should we be able to also specify the race of drivers and passengers too? Slippery slope. Uber will defending this in court it rolls out nationwide. Actually California with Unruh might be enough to start the first lawsuits.

I never said anyone is being refused service. Don't need that standard to be liable in court. Being treated differently because of your sexual orientation can be enough. Uber is furnishing the discriminatory "preference setting". Hopefully they will pay dearly for it.

Uber may have gotten away with this "in other parts of the world" that dont have anti discrimination laws like we thankfully have in the USA. Males here, as shown in the last election, are fed up, and willing to fight for equal rights. And any male who identifys as non binary and is removed from the platform has an even better cause for litigation against Uber.

I think the "non-binary" provision keeps it all legal as anyone can still ride with or drive women. Otherwise, outfits like "seejanego" and "sherides" were shut down and sued by males who enforced their rights.

It's really MENS fault that this has gotten so far. Unfortunately, men do not scream about women only things like women scream about men only things. When men do stand up against discriminatory, female only things, demand access to girl's stem classes, girls fire camps, women's scholarships, mud girl competitions etc, it either stops or in the fine print below the discriminatory headline advertising to dissuade males from applying, it will say "open to all genders".

Thats certainly progress but it is still unfair. " Women" Award," Girls "Fire Camp, "Womens" Fire Training Boot Camp, "Girls" Stem etc. These settlements should stipulate language eliminating gender. Until then, it's still discrimination against men, in many cases, using our tax money.

I would say until its proven that they aren't doing the job equally with male co-workers, they deserve the same pay. I cant think of an example when they receive equal pay but are not doing the job. Maybe if you consider discriminatory recruiting for a job(girls fire camps, easier agility testing for females for police and fire). But not doing a job once hired the same as male co-workers, I just don't see it and I'm a big time mra.
