Idea: try drawing up a legal agreement which you agree to pay full child support but legally have 50/50 custody. Later if you need to, you can challenge the child support on the basis that custody is 50/50. I am not a lawyer. Please consult an attorney in your state for whether or not this would work.

Thanks, I needed to hear this. This is my biggest worry- that he grows up thinking I took him away from his mother and he resents me for it, or tries to go "live with her" when he is a teenager. The real problem with this that while you and I both know there is no chance in hell she does not violate the order again, the judges most likely won't do anything until she does and I have solid proof. And to pursue anything otherwise based on the marriage and pregnancy would be an exercise in how to spend $30k on the lotto ticket of whether or not the judges thinks it is important enough to revoke her visitation over.

Hi! Disclaimer, I am not a lawyer. However, I am in Texas and have 5+ years experience with the TX family courts. As such, here is my advice: One: Get a lawyer who is familiar with your county's family court judges. This lawyer will know them and their tendencies and what they allow/don't allow. Wow. I feel for you. I am worried every day about an accusation like this affecting me. I have seen it happen to a good friend. He spent almost $100,000 fighting the criminal charges before the case was dropped, and he didn't see his children for 10 years. His relationship with his kids is permanently strained and the attorney's fees caused him to file bankruptcy.

I wish I could. I have no idea where to start, and I feel bad for even having the thought. All I know is I have spent literally somewhere between $85,000-$90,000 over the past 5 years on this. I have had to borrow much of it, which has strained relationships and made my financial situation much more difficult than it should be.

I live in an "at-will" state, so I do not believe I'd have any recourse, which is another reason I am worried. Thankfully I have been at said company for over two years now, and hope that my history with them counts for something at least. Another problem is I have been sending out resumes, and this website popped up right around the same time I started doing that, so this maybe be hurting my chances at future employment more than my current employment, at least for the moment.

But it very clearly is her, as it has a picture of her and our child, and constantly refers to "My ex husband, my child's father, my child", etc. Of course my name is dragged through the mud, while hers is not mentioned once.

You're assuming I'd get anything out of her. This is the same woman who has her boyfriend paying her child support, is unemployed, and just maxed out her third unemployment extension. In Texas, for one child, regardless of custody split (i.e. 90/10 or 51/49), it is health insurance cost plus 20% of the non-primary parent's remaining. Basically, regardless of how often the non-primary parent sees their child, if they bring home $3200/month, their child support is 20% of $3200 minus health insurance costs. Don't be intimidated. Seriously, speak to a lawyer ASAP. As for the child support issue--she can change her mind in 3 years if she wants and sue for backdated child support all the way from your child's birth. Or as part of your legal process, the judge will order you to pay (or her if you get custody). Seriously contact an attorney first thing Monday morning. The initial consultations are usually free.

Being bipolar shouldn't affect those rights unless you are crazy and it is controlling your life. Be sure to bring every bit if documented communication to the attorney. I recommend doing this ASAP. I never asked anyone to feel sorry for me. Also it was not my choice our son to grow up in a "broken home". Actually it was ex-wife's choice when she drained my savings, took off with our son, and had me served, all behind my back. I was trying to be a good father and do the honorable thing and be faithfully there for ex-wife and my son, but she made the decision to take that option out of my hands.

To be honest, I kind of have done something by using all of them against her in order to get custody in the first place. It especially helped that she tried to lie to the judge about it, and got caught in the lie with her own words. It's like the main problem is every time somebody new gets involved, I have to start the story from the beginning and explain to them that she's a habitual liar. They don't always believe me, despite the evidence.
