It takes a lot to get a judge to issue death penalty sanctions, especially in domestic relations cases. This one’s on your lawyer, friend. Go hire a legal malpractice guru and shift this loss to the party who caused it.

Most urban counties have standing orders which block a whole lot of transfers until further court order. She’s full of shit, but you knew that…

These (divorce and death) are the Hammer and Tongs of Fate, the Slings and Arrows of Outrageous Fortune that makes us question our own Existence. Ate there other things that challenge us more? Best of Luck and May You Find the Peace you deserve.

100% agree with those opining this is a jurisdictional issue, which is on the lawyer who filed the case, and the other lawyer who didn’t catch it. In my state you have to be a state resident for 6 months, and a resident of the county where the divorce is filed for 90 days for the court to have jurisdiction, the legal power to hear and decide the case. Litigants cannot agree to waive a jurisdictional requirement, as in ‘let’s just file it in municipal court’ or ‘let’s file in a county where nobod…

I am in a community property state, non-military, so I don’t know much about your situation. By letting folks know which state you’re in, you might get more relevant advice. I wish you the best of luck. A common theme here is you chew your foot off to get out of the trap, but the misery fades.

There may be a TRO entered in the divorce; these typically preclude one spouse from denying the other access to the house (unless there has been DV, etc.). Some explicitly say the locks are not to change. You should also have a copy of the TRO handy.

Texas lawyer here, served thousands of defendants and respondents, many who absolutely dodged process. She doesn’t have to sign anything if the papers are placed in her hands. Your processor could drop them at her feet. Typically people will waive citation if represented. Even if not lawyered up, your lawyer will prepare a letter with a waiver asking that they agree, sign and return using SASE for return. If they insist on personal service, which is their right, the processor signs and files a r…

Quick take, broadly applicable but lacking in subtlety or nuance: It’s a form of fraud, especially if done with a transferee: fraudulent conveyance. In a community property state, hiding community property from the co-owner spouse is a fraud, they can get the transfer reversed, attorney fees and possibly punitive damages. If a transferee is involved, they are on the hook as well as a co-conspiracy. Just suck it up and get a prenup if there’s a next time.

‘No gag reflex’. I just spit beer through my nose. Shortly after separation I fell hard for a woman with world-class skills who also just happened to enjoy these things herself: it’s always too good to be true. After a drought water from anywhere will save a dying man. Stay strong, you’re in it for the long haul. Lawyers are pricey but not as expensive as getting your ribs stove in as a pro se litigant. Live with the suck (or no suck, as the case may be). Life is long and the future is rarely cl…

There are jurisdictional requirements. Depending on CA law, 5 months may not allow a CA court to have the power to grant a divorce. Contact a CA divorce attorney for a quick consult, usually for an hour ($500) of their time. Research ‘CA divorce law jurisdiction requirement how many month must I live in CA before I can file for divorce there?’. Hurry, my state requires only SIX MONTHS. EDIT: ran the search. CA is six months. Not sure if you need a CA lawyer to file to have the divorce dismissed,…

Oh wow, look for your wife/ex at r/bpdlovedones. My entire horrible story is there. Surreal. Chewed and shit out after a semi-affair during separation. OF COURSE the bpd got into my phone and CALLED MY SOON-TO-BE-ex to ‘set her straight’ about the situation. My world in ASHES, radioactive ashes. So fuckin’ stoopid.
