The defence sometimes cannot make use of supporting statements due to rules of evidence on hearsay. This is an intricate topic and doesn’t always apply but it’s not clear cut. Agree with what you say on whipsawing.

If you’re buying out your spouse, surely you want the appraisal to be lower so that the half you pay is less. Maybe I’m missing something ?

As with all negotiations, judge by the quality of the deal you’re getting. If you’re unhappy seek a second opinion and if necessary switch then.

In a prosecution the police only look for evidence that can be used against you. This wouldn’t even make the cut.

Let's take a look together so . . . Ive told her that i feel she is very controlling and I feel like Im responsible for keeping her happy and if she isn't happy I can't be. Check Any argument or issue is something I have to fix regardless of who is right and who is wrong and if everything isn't her way than neither of us are happy. I think there’s more going on here than just the church. He’s clearly living with an abusive partner. He’s at an age now where he’s able to see the abuse. He has grown beyond the church which sheltered and controlled him. They have very little in common and a weak connection. While he may have known all this up front(and I doubt he recognised the abuse), it doesn’t help to say “you made the bed, now you get to lie in it”. Nor does it sustain an obligation to stay with a harmful partner who is cl…

It did a lie, it’s a lie of omission and it’s not tolerated by the court. When parties take the oath it’s covered by “. . . The whole truth . . .” Take the evil, afterwards let your lawyer bring up the fact that their declaration had a lie of omission and it will blow up on them.

When I communicated to her the pain she was causing, she looked at me as if to say “you’re a man, you’re meant to keep that to yourself, don’t burden me with your feelings”, each time I did it I saw her lose respect for me, and her body would move in quick sharp irritated movements, annoyed that I had called her on her shit and she couldn’t do it again for another 2 or 3 weeks.

My good man, I’m going to give you the advice your best buddy should be giving you (just in case he’s not). You can make your life immeasurably better by getting off the liquor as a first step. Go get the help you need if you need to. If you need counselling for other problems that’s probably a good idea too. After that you’ll already be so far ahead of where you are now that live will be a breeze by comparison.

Dude that’s hilarious. OP, ask them what they did today, did they see their friends, maybe play sports ? Tell them about the new playground you found, or the episode of The Mandalorian you watched. Tell the, about things you did that you can all do together when you see them. Ireland. In Ireland you’re legally obliged to provide for your spouse until death no matter how short the marriage (unless they get married again). You’re also not going to get a court to issue a sale order on a house if the kids are still living there (up to age 24). She can take half your pension at divorce time, do nothing with it, and find she doesn’t have enough when she retires, and still claim half of your income from your pension at that time. Ireland is crazy for divorce. We even have a…

My friends STBXW moved her BF into their marital home, the home that the court ordered him to continue paying for until the youngest child is 24, (because in Ireland no court will order a sale on the family home when children are still living there or studying as adults). He can’t afford a crummy one room apartment while she has her bf living in the house he’s paying the mortgage on with his kids. Man you could be a lot worse off. Sorry . . . Divorce laws in Ireland burn my ass.

My ex tried to pull this one as well, here’s my response. It’s not their decision, it’s not their decision legally, and they’re not old and responsible enough to make that decision. They are children and we are adults and we need to make the decisions that are in the best interests of the children. You are not making good decisions for your children, they need to learn from both of their parents and there are things that they learn from their Mammy and things they learn from their daddy. I don’t think men can particularly flip a switch, but I think it happens to many people. I think that the death of his father has a large part to play here. There’s a TED talk by Esther Perel that helped me enormously through the breakup of my marriage. It might help you too. It’s called “Why do happy couples cheat ?”. And even though there was no cheating in my marriage, and there seems not to be in yours, it’s about people making decisions that are hugely destructive to their relationships, ev…

The law doesn’t have much room for what people think is fair. And that’s probably a good thing given how shitty people think when going through divorce. I have no doubt that the results would be even more skewed than they are if they took peoples personal viewpoints into account. I always think it’s a bad idea for people to become home makers (especially in modern, developed parts of the world). It takes away their financial and future security, and it makes them dependent on somebody else. This…

The way to winning with a teenager is to be the adult. Simply be calm and controlled and relaxed. Don’t say much about the smearing to others except that she’s doing it and none of it is true and you’re not going to do the same in return. Then change the topic.
/r/Divorce_Men01/03/20 10:24 AM
2

The problem with this kind of situation is that it just becomes a “bad behaviour” competition. The only adult advice I have is to get out (which you’re doing) and keep things calm and safe until you’re out. If you feel you need to do something about it, look up examples of non aggressive dominance. This will take time and patience and will drive her nuts and elicit crazy temper tantrums before it all gets better.

Most of these feelings are normal and a natural part of taking responsibility for another persons needs. In the long term you will find more meaning in responsibility than in freedom. Before you make the leap, you might do an equivalency test on your relationship. Take a look at other relationships you consider to be healthy, functional and successful models for a good relationship. And see if your own relationship has at least equivalent (not necessarily equal) dynamics. Do you both give each o…

I’m in Ireland, that means she gets 50% of everything now, 50% of my pension, 50% of everything I earn in future until the day one of us dies (and I must support her off my own pension too), and if she mis manages / mis spends what she has, she can come back for more (because she has less, and I have more). Just be glad you’re not in Ireland. It’s still worth it.

Listen to your attorney, asking for everything is part of the process. What you have to watch for is her asking for everything repeatedly and drawing out the process to sink you financially. At some point you need to just stop conversing with her solicitor and go to court and ask the court to make a determination.

Don’t need relationship help so much, more like I need a crystal ball that lets me make sure I’m not getting into the same situation again. I feel like it’s high risk, but honestly it’s not because I think women are pre-disposed to acting the way my ex wife is. It’s because I think any human being in that situation would act that way. The law is so egregiously imbalanced, and these behaviours so ubiquitous that the connection between one and the other is obvious and causal. So, I need less help …

In the middle of the divorce process. Ex is frustrating the process just for sheer bloody mindedness, 7 years in the process and counting. Irish legal system doesn’t help either - can’t file until you’re separated 4 years, there aren’t any dedicated family courts except in the capital so I’m in a district court, judges won’t issue a default ruling against a female for fear of the public backlash and ex isn’t taking part in the process. My post history has more detail here and there.

Everybody changes, especially in 29 years. I know I’ve changed enormously even in just the last 7 years since my divorce. But yes, it’s hard it’s real hard. All I can say is that time really does help, and it does get better. It’s hardest at this time of year, too. Take care of yourself and give yourself a break, don’t be down on yourself. Merry Christmas from an internet stranger.

It really does get better but it takes time. Deal with each day one at a time, one thing that helped me quite a bit was something my dad said to me. At the end of each day, just ask yourself these questions . . . Are your kids healthy ? Are they dealing with it ok ?are you helping them as best you can ? Did you do something today to make you and them feel happy with each other ? Stay with it, you’ll be ok.

I agree there’s no reasoning in this situation (reason rarely works in response to emotion) but there are other ways to influence people. My point is that aggressive dominance might make somebody more compliant, but it won’t make them reconsider. We can’t expect to make somebody change their mind in one encounter either, so the OPs example will always feel like nothing changed. We need to break that cycle and find a better path forward. I think the answer to that is in a million tiny victories t…

I would have said exactly what OP said, and left the situation with the woman considering what she did. One thing I like about this post is the stability this guy obviously has in his life - he and his wife take their kids to community events, give them space to grow, come when they’re needed, there is trust between the husband and wife to do what needs to be done. And at the end of the day they spent the evening on the couch together. People who escalate and create drama don’t have that kind of…

It doesn’t matter that you did everything you could. It matters that you both did. Can this relationship even work? What would she need to do & is she capable of doing it? What would you need to do and are you able to do that ? Do you both want to do these things ? These are the 4 most important answers.

Don’t try and explain it to them, just listen to them, let them talk, or be silent, whatever they need. Reassure them about the future and get yourself some help. Sounds like you’ve been in an abusive relationship and you’ll need help restoring your internal structure. And see a lawyer as soon as you can. It’s generally a bad idea to move out and it looks like she’s already dictating the agenda.

In Ireland, the tax on court mandated payments can be applied on either the person paying or the person receiving. So if I am in the 52% bracket, and my wife is in the 17% bracket I can make a tax free payment which she pays the tax on (@ 17%) Other countries have this but not sure about the US

Dude it takes time. I spent 3 years grieving the relationship before I left. Then 4 years putting everything in my life back together again. Why are you more afraid of swatting a hornets nest than of getting utterly fucked in a one sided divorce ? Rule one of divorce club : lawyer up.

Same in UK & Ireland. In the UK the perpetrator must penetrate the victim with (fingers, toys whatever all count). In Ireland the perpetrator must penetrate the victim with a penis. The law in Ireland literally does not allow for a female to commit rape. Sexual assault carries much less severe penalties. The problem here is bigger than just the media.

Op, yes he should disclose the affair to his lawyer. If you want to pursue a relationship with him, I suggest you give him time and space to resolve his situation, rather than planning together to 'win'. There are no winners. In time you will have the relationship you want with him, rushing it will not allow him to deal with the situation adequately, nor his children to process their emotions, all of which will affect him, and consequently you. Let him disclose, let him deal with the divorce, yo…

The only thing I’d say is that divorce doesn’t end your relationship - it just changes it. You still need to figure out how to parent and how to make decisions and how to get along to a degree. I’d suggest really blowing up the dead bedroom issue before going for divorce it might yield something.

There is only one way that I know and unfortunately it’s a long- term option . . . Your daughter might be misled for a few years but she’ll eventually get it. You = maximum adult.

I grieved through the last 3 years or so of my marriage. By the time I left all the grieving was done. I was still incredibly upset for about 2 years afterwards but I didn't miss us, nor the times we had spent together, and when I looked at photos of us they seemed to me like different people.

You have no choice but to reinforce boundaries here. If you don’t it will keep happening. Don’t consider it a money win/lose/draw game. Consider it buying her adherence in the future. Be direct and be unstoppable and be brutal. Sorry, that has a little to do with my mood right now.

That can happen also if you do marry. I'm not sure I can offer any helpful suggestion for you - sorry. Have a chat with the good souls in r/deadbedrooms for an insight into sexless marriages.

Do you see him do this in other areas of his life ? Shut out people, uncomfortable situations or places he's had a bad experience ?

I really don't think this is a gendered behaviour. I find it very difficult to communicate with my ex (mostly because in our relationship she would shut our communications down as a punishment for not getting her way) I still see her 5 days a week when I see my kids and we hardly say 2 words to each other. However if she got sick I'd help any way I can / any way she'd let me (she's a proud woman and likes to embrace / create suffering).

Man, this would just about kill me. False accusation in order to “Win”. No thought given to the child. Not sure what I would do either but I feel for you. Keep your chin up.

Thanks here's a link with less click bait and more detail http://www.scnow.com/messenger/article_ffd17e16-4fce-11e8-8062-371936df7404.html My favourite bit : “By late afternoon, the statements made by the alleged victim and her friends when interviewed by police simply weren’t adding up All the friends should be charged with making false statements and perverting the course of justice too. Unbelievable.
