Realistically bond has always been capricious and up the whims of the judge. I've been building a list of the dumbest bonds set. Its really fucking sad at times. The 8th amendment doesn't really worry about excessive bail any more, or the inverse.

I think the more secrecy there is in a trial the more likely there is to be abuse. Also the character of a witness is important. Who they are, their relation, their history, it all adds to their reliability. I also think that changing things for specific types of crimes sets a very bad precedent.
