I guess my question would be better asked as was she given full physical and full legal custody with all decision making authority. I imagine an order preventing ALL communication also basically makes video visitation impossible. Are the kids named in the order? Did you guys agree to an exception for communication only being done on a parenting app to coordinate parenting time? It would be incredulous for a judge to order something that would rob your two children of a father in the most formati…

What is the status quo? Does the Protection Order prevent shared custody?

I hope he's just as relieved as she is.

Thank God there are no children involved. I do wish I didn't have two marriages under my belt. I deserved more than what I believe I deserved. Not a word of consideration to the person she promised forever. I would love to hear her husband's point of view though. She wrote this like she was writing a fantastical short story for upvotes.

1.) What marital assets do you have? 2.) Has she maintained full-time employment? 3.) What debts do you have? 4.) Do you share finances and if so, who handles playing the bills?

Pay more for an aggressive attorney now because you’ll lose more having to battle in court. If you can avoid a trial, do it.

The bullshit of reunification as a punishment for domestic violence without the children being abused in these cases is damaging to the children completely. Nothing tells the children they aren’t safe like supervised visitation by a facility. You immediately will always lose in any sort of custody dispute. 6 months to only get every other weekend if that. The only factor I would assume happened in your case is they witnessed (or that this was alleged) the abuse? If you have to go in front of the…

You have to exchange your most up to date financial information. Typically I would do three years tax returns and if you make commission or bonuses, I would identify those bonuses yearly and commission each 12 months to show possible fluctuation. I’m not sure what you mean by split payments. Was there already a ruling on money owed or to be paid monthly? You share yours and if she doesn’t share hers then you file a motion to compel. If you wait too long the only downside is if settlement confere…

The only person that’ll be in trouble is you if that didn’t get cleared up. That’s your kid until then…legally.

Sounds like you have more to lose staying than leaving. I’m guessing there is no equity as well. Does she work? If she gets pregnant you’re absolutely fucked so suit up.

Yeah. That’s a tough one for sure. 7 and 7 just isn’t appropriate. What about a 2-2-3 to get through the next few years? I see that more often with infants. It’s also a smooth transition to a 4-3 and then eventually the 5-2 you are wanting.

If your youngest isn’t in preschool until fall of 2028, does that mean you have an infant or is she still pregnant? Week on week off is practically unheard of with a child that young.

Unfortunately child support is a set calculation and what you were paying seven years ago doesn’t mean much with inflation and has less purchasing power. Nothing you mentioned matters. The only consideration is your income, a slight deviation for your other kids, and your overnights. How often do you have overnights?

This is worth mentioning in your divorce. Twist it to protect your child and your beliefs. Abuse is abuse. This is abuse of both of you.

Give up the ghost. Filing first is a necessity. You can be amicable and divorcing. Get the upper hand. File the papers and request exclusive access to the home so she is forced to leave and support herself. She is working and capable of full-time work. If you leave the house, you’ll be supporting two household’s until the divorce is finalized and the asset is split. Fuck the home and request it be sold for equity. You don’t want to fight over it. It’ll drag your divorce. Get an appraisal now. Do…

Correct, which is why it would be safe to assume the audience has experience with going through a divorce, maybe even pro se. From what I’ve experienced and seen, men tend to be at the receiving end of tactics. There are tons of recent posts with individuals asking for advice. Your original condescending commentary was an incorrect assumption that I am the individual who needs the advice. I agree reading is fundamental, and I encourage you to make your way back to the description of this forum. …

Thanks for the information. I did see that clause. I guess the confusion is you are able to serve documents electronically through the efile system, which appears to be different than email. Filing the request two days after she was served is a bit of a dick move considering they have 45 days. I guess he wants to make sure it was actually filed with the court so the judge is able to see that behavior. I will ask him if the papers he filed had anything registering email service. The financial sta…

It’s pretty clear from my post history I’m a woman, and I am indeed asking for a friend. The question wasn’t what to answer to a question, it was if serving my friend through email without my friend declaring he was willing to be served through email was allowed. It seems Massachusetts requires the pro se party to agree, and I was looking for confirmation. My friend is able to produce the documents, but wants to make sure the lawyer is serving the paperwork properly.
