You know. Some days when I read article on here, I can usually brush them off. This one is an exception--even more so since I am literally in the law field of disability rights. Yeah, that's the main sucky part with state (within the U.S.) Civil Rights Office's--it really takes everything out of your hands. And at most, they usually just fine people and revoke licenses if those are potentially on the line. Actually, I'm pretty envious of the Canadian tribunal systems. I know a guy who got his law degree in Canada (but now is in the U.S. and practices there) and he always does a great job explaining the differences in those tribunal and the state OCR's.

It can get a bit trickier with private universities, but the basic test that a plaintiff in such a case would have to prove is "state action". To explain state action as simply as possible: there's enough of a connection between the "private action" and the state (or government). If there's enough of a connection, typically one would sue under the 14th amendment--which is another loooooong conversation of how that works. Just because you seemed interested ;)

I did my undergrad in a SUNY (The State University of New York) school. I came across this section in my treatise textbook for my family law class--I have to take the class as a required bar foundation course. Honestly, this disheartens me to no end. I feel ashamed that future colleagues in the legal profession have done this to a human being. Wow, and this is coming from the NYSBA Family Law Review - and in 2006 nonetheless. For me personally, this is why I do not like family law and try to get every chance to shy away from it. Past experiences with those situations give me terrible anxiety for parties involved, especially when it includes a child in situations that are described in the article. Nonetheless, this is a great secondary authority for anyone in the world of law - if only OP could find part II to the article.

I do agree with your opinion. As from my perspective, it was in the back of my mind that the referenced statement was a shit test. One could argue that there is a diminished quality of a person who performs a shit test, meanwhile another could say it's just their way of filtering through potential suitors.
