I agree that context and intent in itself matters, but the issue here is the motives behind why those photos should be allowed. Given that PIE was associated with the NCCL, it was obvious that the intent was to use this as a loophole to promote existence of photos of indecently exposed children. as far as I know, if you're on a phone call and you're recording, you need to tell the other person that you're recording them. not sure if that rule applies to person to person meetings but if it's in private property I wouldn't be surprised if it does apply.
