I doubt what you describe would hold up in any jurisdiction when dealing with a non-police arrest. It would be good to see independent evidence of this assertion as I am interested in knowing this for a fact. Obviously, the video evidence may change things since it would be her word against his in most precedents. Retailers are in a pretty good position to establish good security procedures. It could be as simple as building shelves to be maze like and asking customers what they are looking for. Locking up the high value items, etc. Obviously, the real pro thieves would still need to be countered with even more sophisticated measures. the OP is not denying any sexual contact took place at all. Even without clear cut DNA evidence it likely becomes a he-said/she-said case. If the case goes to trial, the judge or jury members (depending on if a jury trial is selected by the accused) could have issues with young unmarried people having any sex at all and put the blame squarely on the man and vote guilty.
