Not nearly enough info. State? Kids? If kids, what custody arrangement? If you own the house will it be sold or will one buy the other out?

Everything is correct except her not getting an attorney. If they own a home or OP has a retirement plan they can start draining that to pay for a lawyer. It's called a QDRO. My ex drained most of my retirement savings. Otherwise, yes, cut the money flow. They're still living together so he should get a body cam and wear it always.

Spit and slapped? Yikes. Given your situation I would've called police and ended up with full custody.

Ideally. That's up to how the divorce is. Amicable or contentious/vicious. Hopefully it's the prior.

She's not yours. It was just your turn. This happens to countless men every single day. Sorry, man. Lawyer up ASAP and file first. Make sure you get no less than 50% physical custody of you kid(s).

This is why I'd never enter into a stepparent relationship. I've had a stepdad for 35 years and the way he treats me vs his other two bio children is night and day. He even treats his nieces, nephews, grandkids, and everyone else superb and just tolerates me. I'd never want to be a stepdad because of that. You're never truly wanted. "Red-headed stepchild" is a cliche for a reason. You're the red-headed stepdad that your wife latched on to so you could work 7;days to provide for them all at your …

You did nothing wrong. Your brother has a lot of growing up to so. So, if he's holding a grudge for this that's his problem. You've done enough reaching out. Let him come to terms himself in his own time. Meanwhile, when you see each other just be cordial and friendly. Maybe the ice will break at your parent's house or a reunion.

I don't care what dumb overused ad hominem you choose. The law is the law. Most adults understand that if they've gone past the 10th grade. Not sure if you're 13 or what. "Given them back to her?" She fucking already has them! She was ordered to turn them over to him. Look, I can see someone maybe getting lost in an article. But, you got lost in the headline. Damn! You win two wooden nickels for playing today. Thanks for the laugh.

The point is the rings were a gift to her just as these pics were a gift to him. So, if he has to return her gift then she should have to return his gift, right?

1

Newsflash. If it wasn't newsworthy it wouldn't be in the news.
/r/PussyPassDenied28/09/22 08:20 PM

I'm not making fun of her. It's newsworthy and she expected the law to not apply to her. Well, guess what? It does.
/r/PussyPassDenied28/09/22 08:07 PM
1

Take your case to the Utah legislature. I didn't write the laws. Neither did the judge. The judge just enforces the law.
/r/PussyPassDenied28/09/22 08:05 PM
1

I'm not mad about it at all. I've been married and I know what rings cost.
/r/PussyPassDenied28/09/22 04:49 PM
1

Then she shouldn't have gifted them to him. If I gift a car to you I don't get to later force you how to drive it or maintain it. Sure, they are laws against sharing them if they contain nudity. But, that isn't the case here. She was told to edit/blur the intimate areas of her body before doing so. But, even that I feel should legally be considered "destruction of property." If I was ordered to give you a car back that I gifted you I don't get to take a spray can and vandalize it beforehand.
/r/PussyPassDenied28/09/22 04:48 PM
1

In the eyes of the court and law it makes it right. Like I said before, she could probably barter with her in exchange for the $25k engagement and wedding rings he likely bought her.
/r/PussyPassDenied28/09/22 04:07 PM
1

As someone with a legal mind, who has been to divorce and family court more times than I can count, I indeed view this through a legal lens. The judge never cared about my feelings or "morals." The only thing that mattered was the law and, unfortunately, judicial bias in favor of the woman because of the sole fact she was a woman.
/r/PussyPassDenied28/09/22 04:06 PM
1

We're discussing legality because this is a legal matter. Do you want "morality police and courts" like they have in Iran who can beat, imprison, and maybe kill you for not wearing "appropriate attire?"
/r/PussyPassDenied28/09/22 04:04 PM

So, under the current law I'm correct. Thanks.

I'm not ignoring anything. You are. He has the right to keep his property. You're ignoring that and trying to throw her a PP.
/r/PussyPassDenied28/09/22 10:12 AM

Right. She kept the rings and he's keeping the pictures. Both are exercising their rights.
/r/PussyPassDenied28/09/22 10:08 AM

No. I'm challenging the previous person's assertion that an affirmative, "but, I'm a girl" statement has to be made for a post to fit the sub.
/r/PussyPassDenied28/09/22 10:07 AM
1

She has the right to keep her engagement and weddings rings, that he bought her as a symbol of a lifelong commitment, but women never return those.
/r/PussyPassDenied28/09/22 10:05 AM
1

Women have no problem lobbing false DV allegations to get the upper hand in divorce. Happened to me. So, yeah, I'm pretty callous at this point. See? That's the law of cause and effect. We have no idea how she conducted herself in this divorce. His asking for his pictures of her is an indication is was far less than amicable.
/r/PussyPassDenied28/09/22 10:04 AM
1

We're discussing legality rather than your personal ethics. Courts are about the law. Not feelings.
/r/PussyPassDenied28/09/22 10:01 AM
1

He owns them. Why don't women return their engagement and wedding rings in a divorce? After all, they were tokens of what was supposed to be a lifelong union.

So, if I take a picture of you in public then it becomes your property?
/r/PussyPassDenied28/09/22 07:08 AM

Not according to the law. And, this is a court case with a presiding judge. Context.
/r/PussyPassDenied28/09/22 07:05 AM
1

Not at all. I can post it to FB if I want (unless it's a nude). I doubt this woman copyrighted (a legal process) a gift she gave. And, now that she's already gifted it to him she can no longer copyright it as she doesn't own the copies he has.
/r/PussyPassDenied28/09/22 06:38 AM
1

Maybe. Maybe not. Either way, they have no right to. They could ask it as a favor. But, legally they can't force me to. I know she has some of the same and I've never asked her to.
/r/PussyPassDenied28/09/22 06:29 AM
1

You asked if she used her gender to her advantage? The clear answer is no. I guess based on popular posts that wasn't required. You're using selective judgment here. You wouldn't be a good judge.
/r/PussyPassDenied28/09/22 06:27 AM
1

As was mentioned before by many others; this was probably a nasty divorce where she did unethical things to him, legally, so he just returned the favor.
/r/PussyPassDenied28/09/22 06:02 AM

Nope. I have nudes, and even videos, of exes and have never shared them. They were intimate moments between me and my girlfriends. Only a pig does things like that.

In a contentious divorce a real woman wouldn't lob false allegations against the father of her children. But, it's surprisingly common. I guess that's where the saying, "all is fair in love and war" comes from.
/r/PussyPassDenied28/09/22 04:01 AM

My guess is she did some dirty stuff to him in the divorce so this was his way of firing back in whatever petty way he could that he knew would piss her off. Have you ever gone through a nasty divorce? I have. Trust me. Women have all kinds of way of torturing you through the process both with your kids, the DV system with false allegations, and withholding your children. Men don't have a lot of ways to get back at them and I figure this was probably one of the few he had. Petty? Yes. Justified?…

Your ex is just like mine. She tells everyone I'm a deadbeat. But, my kids know otherwise. I fought off and on in court for 10 years, spent about 80k in attorney fees, had a brief mental breakdown over it. Let her spread her rumors. She her spin her narrative. Here's the lesson for all of the readers here. DO NOT GET MARRIED. This guy was with his woman for 10 years and it was still good enough to where he thought marriage was a good idea. Yet, only 3 years into the marriage it's all gone to shit. Had he not married they'd still probably be together because he'd be in the position of power. Once you wife her up the power shifts to her. r/AgainstMatrimony

Al I can say is you're trying to buy her amicable treatment by voluntarily taking it in the ass. You're giving her everything, but also paying for everything (giving her all property and cash while agreeing to pay for daycare, schooling, etc. You're right. She will demand more... at least child support because that's an easy win. Alimony is a tougher fight so she'll need to do that in the initial divorce. I had full custody of our kids and dating was out of the question as the mom didn't come around too often. But, the weekends she did I would get out just to enjoy myself and get my head cleared. Since you have every other week off you should be able to date. When we moved to week in-week off custody I would date others that had the same situation. Both of my main girlfriends had week on-week off, too, so it was pretty convenient.

You need to find an aggressive attorney to file a Motion for Criminal Contempt. Ask for 5 days in jail. Do not waver. My ex did the same thing and I simped at the hearing and only asked for probation (which she didn't follow). Behavior like this needs to be manhandled hard and fast.

Try to send it to the state. This way all payments are recorded. When I was paying my ex mom support via check she once lied to the court and said I didn't pay her. I had to file a Motion for Satisfaction of Judgment. So, I had to do all that shit just to prove she lied. She admitted in court and said "she forgot." Oh, yeah. Agreed. Cut back on OT and mitigate with cutting back on household expenses. Subscriptions, vacations, dinners out, etc. If she's home all day she can cook. In OP's current situation he'll get taken to the cleaners. PTSD doesn't necessarily negate custody especially if he's dealing with it and treating it. But, definitely try to ride it out a bit longer. Once you bring in less money she'll feel it and maybe she'll go back to work. No more $200 salon days for her, etc.

The Bible is an archaic book written by archaic men. They related stories of their lives. Proverbs is an excellent book in the Bible. But, Genesis, IMO, was written by some dude who ate mushrooms. The folly is everywhere starting with the 6 day creation story. For example, God "created light" on the 1st day. But, it wasn't until the 4th day that he created the light sources. https://www.biblegateway.com/passage/?search=Genesis%201&version=NIV https://youtu.be/0muUYASI0HE

If you own the house jointly then you can petition the court for the sale of the house arguing that you are becoming destitute due to defending her false accusations. Absolutely. And, that might make you ex back off if she likes the house and lives in it.

Getting arrested and going to jail, along with the criminal record, will definitely not improve your situation. Yes, she was cheating and that is what led to her doing this. Do you have any kids together? How long have you been married? If you have kids I'd petition for full custody under these circumstances.

File a motion for criminal contempt. She's not following the order. A civil contempt is just a fine that takes money from the family and children. A criminal motion can either put her in the clink for a few days or, if you're nice and don't want that, at least get her on criminal probation which means if she even does the slightest thing to violate it during probation then she's in a probation violation situation.

Document all of this and file for primary physical custody.

One misfiled motion can get you royally screwed. But, even shitty attorneys can forget to file an important document, as mine did.

In addition, if you have a laptop, tablet, PC, etc, that you had during the marriage then WIPE them. No idea what she installed on those to monitor you.

File for equal custody. Mediation only works when both parties are reasonable.

You should feel bad for the chump. He's the next casualty in line for her.

Anything you own is ripe for her taking. Be in a total financial holding pattern.

Don't say a word to the police. If they knock on your door just don't answer. Don't participate and help them with their silly investigation. Don't talk to the police.

And, the thing is even if you do get married for religious reasons that marriage is still governed according to the laws of Caesar.

If you are both reasonable, agreeable, and no-conflict then go for it. Split the assets up and get on with it.

The dreams don't go away. I truly despise my ex. But, occasionally, I have some weird romantic dream of her. I'm not even attracted to her at all. When you spend years with a person building a life that shit sticks in your brain and your brain doesn't forget. Just wake up, shrug it off, and let you be on your way.

No,they aren't. But, you need to read the wording of the parenting plan. If she wasn't in the picture when it was ordered then you're in a grey zone if you don't give your ex ROFR if it's ordered to do so. My ROFR had a stipulation of 48 hours or more of absence. You'll have to spell out exactly what yours says, word for word, if you want better guidance.

It depends. Will your wife file a contempt motion on you? And, if so, will the judge dismiss it (like they do 95% of the time) or find you in contempt (rare)? If you want to be fully in the clear then having the wording changed now that your married is the safest way. I'm sure if your ex just agrees to it in an email that'll protect you, too. So, that depends on the relationship you have with their mother. The reason for ROFR is to ensure maximum time for children to be with parents instead of ba…

I'm assuming you're talking about Right of First Refusal. If the verbiage* in your Parenting Plan states that then it can be iffy. If I were you I'd follow it to the letter and if you want it changed file a Petition to Modify.

Probably not. It's considered settlement negotiations. Either way, you want 50% PHYSICAL custody. Sounds like she's just offering legal custody which you'll get anyway. Don't take the offer. Instead, file a Motion to Quash TRO.

Damn. That's gotta hurt. It'd be one thing if it was her golf instructor. But, the Walmart guy?

True. And, the poll reports what has been known for a while. Women usually file for divorce because divorce laws favor them. They usually get the house, kids, child support, and maybe alimony. The husband loses all of that and is usually lucky to walk away with a false allegation.

At least 50% physical custody is the #1 goal unless, for some reason, you can't do it logistically. If retirement funds are at stake then offer other liquid assets to offset her taking tax-protected accounts. If you have a house together then sell it and split the equity to start over. Don't spend attorney time arguing over replaceable things like furniture.
