If she's smarter than the average bear she'll insist on reducing the gain by expenses of sale. Expenses of sale include things like realtor commissions, title insurance, property taxes etc. Of course, you'd only be liable for half of the expenses of sale. I find most people don't put that much thought into it.

In most cases the answer is no. A single taxpayer has a $250K exclusion as long as you lived in the house for two years, but I believe, in fact I'm positive a divorce nullifies the 2 year waiting period. You might be surprised. There are a lot of variables, but the standard deduction for HoH isn't that much lower than it is for MFJ. Nevertheless, in order to keep as much of your money and not have the IRS be your savings account, change your W-4 to HoH. If you're income is high, claim fewer kids on the W-4 as well.

I'm not sure a court would grant an emergency order unless OP also filed for divorce and custody. My understanding is that as long as they're still married, she has as much right as he does to just up and take the kids anywhere and for as long as she wants. The only caveat is, and I say this reluctantly because I don't know exactly how common it is, is apparently permanent alimony is often awarded as an alternative to the separation of assets. If she's entitled to half your pension, maybe alimony in perpetuity is a better alternative than the lump sum distribution from your deferred income and retirement savings. My divorce decree states that we both are to share tax returns annually. Fuck her. She doesn't share hers so I don't feel non-compliant not sharing mine. on my lawyer's advice I filed my 2022 taxes separately and claimed my 3 kids as dependents. This was bad advice. You can't claim dependents unless they live with you more than 50% of the year. Source: IRS licensed tax professional that schools attorneys on a daily basis. Dude... I wish all I got was the side eye. The only place I find a true lack of judgement is with the IRS. My ex has tried to claim our child for the last 3 years and been denied her claim. Me? It's not a walk in the park. That first year was like going back to basics and I felt like I was just out of high school what with the loss of income, house, child and ability to generate income.
