Well, it really hinges on how strong of a defense case you have. The persecutors usually offer a plea deal rather than try a case as it still counts, plus no risk to losing in a jury duty. The defendant is going to loose either way. If the defense has a strong case I wouldn’t see any way it’s a good deal. But, that should be judged by an outsider not the defendant. Student loans being exempt from bankruptcy was a move by “progressive” politicians. The news was full of stories of MD’s, PHD’s and Lawyers piling up debt via student loans. Then declaring bankruptcy after they graduate and getting the debt forgiven. Then these Drs and lawyers would go on to lucrative careers. I’d take this as a misstep due to bad advice. Some other gals can really put pressure on their friends to follow the herd. It would be worth confirming if this is a trend or a one time error. All those advising you to sue may be wasting your time if you are in the US. Trying to prove discrimination will be really difficult. I wouldn’t listen to the calls to sue. Unfortunately the best thing is to let it go. At best it will get dismisses. Defamation usually is only resolved in your favor if it was printed. Like a newspaper article. And by suing her you’d most likely trigger her to file charges so she can bolster her defense. I’d check the statute of limitations for your area though. There is alway the possibility she is crazy or talks to the wrong person and they encourage her to file charges.
