I assume by taking it to trial he is incurring more fees, so he's advising you to pay him less. Ask why. If this is the best he thinks you can get, that's what you're paying him for. He may have ripped up his copy. But the original was always kept at his attorney's office. I've utilized attorney's to close business deals. They always keep an executed copy on hand. You never know when you're going to have to refer to it. It's pretty irrelevant to destroy a copy of any agreement when the original is still in place. I took my daughter to my shop after her senior year and had her mow the 5+ acres with a push mower. She did a good job and was an excellent worker, put a couple of boys her age to shame but after the summer she wants nothing to do with manual labor. Which is fine by me, she's taken that exp and applied herself to her studies getting A's & B's.
