From a legal viewpoint, theft is the act of taking something from someone illegally. Necessarily one must ask the question of what constitutes legality. Any entity that can promulgate laws legitimately. What confers legitimacy? Depends upon the place and time. Presumably you live in the US. The Constitution confers legitimacy in the US.
