1	My ex keeps suing me after final divorce agreement was executed in 2020. If you live in the same state in which the order is in for example, if your divorce was in New York, and you still live in New York , court will have to be in New York. Both parties would have to be out of the state (move) and the parent where the children reside can change jurisdiction. That how it is in most states. Did you not read the OP's statement. The MIL is hiding (concealing) the child which she has no legal right to withhold from the father.. the MIL has no rights.. She (MIL/grandparents) is considered a stranger in the eyes of the court. Like I stated before, grandparents have no right to withhold a child from the parent with no court order... He the father goes over to the residence and demands his child, the MIL will has to give he child to the father if the mother isn’t present. Facts. Clearly what you’re not understanding, yes the mother can leave the child with the grandparents but the grand parents cannot deny the biological father/husband the child. If the cops show up, and the mother is not present, then grandparents would have to relinquish the child to the biological father, because the grandparents have no rights. In fact, you could call the cops and have the mother in law charged with kidnapping. You need to also get something in the courts that establishes a visitation schedule ASAP (like a temporary order). Other wise you have no real visitation nor anything that establishes custody.
