I don't know if you saw that Coughlan rejected that comparison Coughlan is the Supreme Court Justice. Attorneys try to draw parallels all the time, they're not always right. When they're not the judge knocks them down... as happened here. and... consented to sex on the understanding intact condoms were being used so it's protected sex still... no babies and no STDs is still no STDs.

Unprotected sex refers to STDs not babies. As birth control offers no protection from STDs you are already consenting to unprotected sex if you consent to sex under the belief that she is on birth control. Since the judgement in this case depends on not consenting to unprotected sex it would not be used as precedence to build a sexual assault case for someone that lied about birth control.

The obvious difference is that unprotected sex is talking about protection from STDs, not babies. Birth control offers no protection from STDs.
