Just finished 6 months in jail for "Willful disobedience" for failure to pay $2,300 a month in child support. Had my "downward modification" hearing a week after getting out of jail. Explained that I had no income, no job, money and JUST got out of jail, to which the magistrate responded, "None of these are valid reasons for a downward modification." I did not fight her for primary custody, however, I had easy access to them and the longest I went without seeing them was 2 weeks. There was a situation where I could have gained primary custody, but, I was not looking to be malicious and decided to leave custody with her. The jail time was because I couldn't afford the then $3,000 a month in child support. (I also refused to pay anything until I turned myself in)

You can make a claim for downward modification, which I've done on a couple of occassions, but they never bring it down. The first time I did a downward modification I was without a job. The magistrate stated I'm not going to give you a downward modification when you don't have a job, go find a job and come back for a downward modification.

I would argue further that one aspect of why the economy is in the shitter is precisely because the Federal Reserve enables politicians to push their moral agendas on cheap money, growing programs like child support through bigger government and actually creating more harm than good.

The child support system is broken and unfair. Just like every other government run program. The welfare of a child is the responsibility of the parents. To infringe on the liberty of a dad from the moral standpoint that it benefits the child(ren) is bogus. It is theft, plain and simple.

All of them. Don't have kids. Dealing with Family Court is a nightmare, I'd imagine in any state, but I've only had to deal with NY so far. I owe over $100K in arrears and my monthly support is over $2K.

Good advice. I have a private arrangement with one of the mothers of my children, it is much easier this way. Respect her decision, but definitely get a DNA test. I did a DNA test on all my children without the mothers knowing. The kits are cheap and easy to adminster.
