Stepdad has no legal authority. He has no legal relationship with the child. Because mom and step dad are married, step dad is as equal as mom as long as they are not overstepping dad's designated time. (that's my state, YMMV) Where I disagree with mom and I think dad has a legitimate gripe is confusing the child with the daddy title on the wrong individual.

The only thing you should be concerned with is if step dad is being good to your daughter. These comments show that your lawyer does not know the judges in the court. Try to find a more local lawyer with experience. Do some basic research on judges and ask the lawyers opinion on them. If your case already has a judge assigned ask if your lawyer has been in front of them and their experience. You're looking for specific answers here and not open ended generic answers.

take a step back and pretend you're the judge and this sub is your case load. How much do you really want to get deep into the personal aspects of every case? Not possible. I moved my girlfriend in for 2 years before I filed. Lots of extenuating circumstances but did it have bearing on my case? Yes. It showed me as a stable family unit for kids.

This is very much. Courts dont care about the drama, unless there is violence or a threatening environment for the kids. What you want to do is appear as reasonable as possible. You want 50/50? Sooner is better to soothe your fears. I wish I had started mine much sooner. Just do some research through the state bar association and make sure to find a lawyer who has been doing this for a while and jump in.

I know its not easy to do so, but, relax. In hindsight you will see that this is a short term issue and a small one. Just make sure that the language for resolving the car title and refinancing the loan (with a specific deadline) makes it into your pleading for final to the court and you'll be ok.
