Actually I'm not a lawyer, so it could be an interesting topic to look into from a legal perspective. Not having sex is fine, but the "we're not having sex" is not always a no-signal. In the same way you can always back out of having sex (even with your pants down, you CAN change your mind!), you can also back into sex. You should feel comfortable navigating this territory. Once you feel that urge to touch, it can work just fine to fiddle with her hands playfully and combine with things like sharing food.
