Once again, if you set off a car bomb when you turn on your car, if you don't know about the car bomb its not your fault if it kills a bunch of bystanders. Same thing here. The judge is probably right this isn't a crime. However, there is clearly a problem with the law here if the judge is right. Look at this states extortion laws. This should fall under it. Posting something online sends the information until it is "removed". Right. There are forms of consent other than verbal consent. The most blatant form of non-verbal consent is, taking the actions to make sex physically happen. Generally places that write good laws don't let you get a pass on things like "could reasonably [know] X" if you intoxicated yourself. Obviously if one spiked the others drink, the first should qualify for something along the lines of poisoning in addition to rape charges, and the second should get some level of a pass due to intoxication.
