I don't know what state you're in but in Florida a new law took effect this summer. They eliminated permanent alimony. You will be better off settling our of court. Yes, the system is unfair.

Even though a judge has discretion, that discretion has limit. There are strict laws on the distribution of assets and liabilities. You got to be ready to appeal. Always have a court reporter a the hearing. I also recommend that you read appellate opinions in your state. It is extremely informative, even if you have an attorney. It is still considered marital asset/liability; it doesn't matter if you knew about it or not. The game starts at 50/50 split on asset and liability with some exceptions (i.e inheritance).

50/50 split is not automatic. But with the length of the marriage and the fact that she did not work, it is very likely it could go 50/50. The irrevocable trust strategy is not bullet proof. In Collier v. Collier the wife strategy failed because the judge and appellate court agreed that her action was dissipation of martial asset. She hid the trust from the husband; furthermore, the husband was not a co-beneficiary in any way.

Well...you're in a good position if she makes more money than you. A good lawyer should be able to put a good fight. Look up the statutes in your state in learn about your rights. Judges and lawyers don't always respect the statutes during distribution.

The other option if you decide to go for marriage is to draft a prenuptial agreement. Marriage is a contract. The court will enforce a prenuptial agreement. It is similar problem in probate. When the system get involved it gets messy.
