What it seems happened is. Male lied of age, female assumed he was legal. Judge said any person could make that mistake so it's cool. Legally correct and in theory should apply if genders were switched. In practice unfortunately it doesn't. But the case law is now set for men to use as defense,though I wonder how a judge would take "but she looks adult to me" as a defense...

Unless there's a court order the default presumption is that the female gets the benefits. Note this also does not mean mother there are cases wherein a biological father lost benefits to his spouse, who was not the mother. So without a court order in split families for instance CRA defaults payments to the mother no questions and will fight the father that is written in their policies.

It's specifically written so. Without a court order, fathers single or Otherwise can not get the benefits unless mommy consents. in about 40% of rape accusations, the accuser will admit they've falsified their accusations. Why aren't 40% of accusers then in jail? Cops and justice don't care about male victims; in fact most cops report them wrong anyways, and departments fudge the numbers, and justice reports will only enclose convictions for it. Sorry deleted my reply, I did want to expand on this point, but felt it would've been too much of a wall text; Not all separations come with an agreement sometimes you can spend years in court trying to get an order. So by default they give it to the mother, now unless the mother says that the child is with you, they default to her, so either way you still need that permission slip, unless you have a court order.
