A male of the same age would have been given the same sentence under Canadian law. There’s not any judicial discretion that can be exercised to charge a minor as an adult. In the USA she would likely have gotten worse in most states. In any country comparable to the USA e.g. Canada, Australia, almost all of Europe, etc. there’s a stronger focus on rehabilitation. I think the point being made is that minors are not given the rights of an adult e.g. to vote, to buy alcohol/tobacco, to drive, etc. If society says they’re not equipped to do those things because they’re not adults, it’s counterintuitive to then try to hold them accountable for crimes as if they were an adult.

I don’t think it’s related to gender. Most countries try to do as much as possible to rehabilitate minors. Kids can be so clueless about the ramifications of their actions. Sentencing them as adults, when they’re not, isn’t considered normal in much of the world.

I think it’s because it would be pointless to withhold the person’s name only while they’re a minor. The idea is to allow them a chance to still have a life, after they’ve served time for whatever crime they committed as a minor. If their name gets released as soon as they reach the age of majority, that chance would be gone.

That said, the “disrespectful or rude toward a judge” is something I’ve only ever heard of used in a courtroom. Outside the court you can say anything you want about them. It’s one thing if an informed adult decides to be circumcised, for reasons of religion, or otherwise. It’s another thing entirely to circumcise a baby, that has no way to be a part of the decision. It’s bodily harm, if it’s not the result of a decision made by the person, to whom it’s happening. In her defence, because she’s incredible and strong as a force of nature, I think her point is that it should be okay to have a Supreme Court bench with all female justices, not that we should do anything to ensure it happens. The fact that she was a good friend of the late Justice Antonin Scalia, who was her polar opposite on the bench, speaks volumes about her ability to see past an individual’s personal views, to the core of who they are.
