Take a moment to consider where your lawyer attended law schoolSo, those are LLMs which then have concentrations. Even though I went to Albany Law School (#4 on that list), the only people who would be doing LLMs were international students while I was a student there. I have yet to encounter another family law and divorce attorney in NYC since I've been practicing law who also had an LLM in Advanced Legal Studies with a concentration in family law. | /r/Divorce_Men | 23/01/22 05:01 PM
Take a moment to consider where your lawyer attended law schoolTwo problems with this, at least as it relates to the United States : 1) almost any lawyer who graduates from a top 20 school is going to work at a "Big Law" firm doing some variant of corporate law where their starting salary right out of law school is $200k+. 2) I'm not aware of any masters program at any school which issues a family law masters degree. | /r/Divorce_Men | 23/01/22 02:52 PM
Take a moment to consider where your lawyer attended law schoolYou understand that each time you hire a new lawyer, you have to pay them to just catch up with the case? If I come into a case that has already had more than a year in court and a number of court appearances, it may take me 5-10 hours just to catch up with where the prior lawyer was with the case. Something else I want to note... The more lawyers you go through, the worse you may wind up with. If a client comes to me and they've already been through 2 lawyers, that's already a red flag to me th… | /r/Divorce_Men | 23/01/22 02:49 PM
Take a moment to consider where your lawyer attended law schoolAs a family law and divorce attorney, it insults me when clients ask what law school I went to. I didn't even take family law in law school. But I've been exclusively practicing family law for 12 years now, and I graduated what will be 15 years ago this spring. Want to know whether I'm a good or bad lawyer? Start looking at online reviews, especially on a site like AVVO where the reviews can't be manipulated in any way. The bad and the good are all listed. I've regularly faced off against lawyer… | /r/Divorce_Men | 23/01/22 02:42 PM
Court tomorrowAs a divorce and family law attorney, my top advice is.... Listen to your attorney. And don't say anything at all unless a question is specifically asked to you. Otherwise you sit there, take notes, write down anything important that absolutely positively has to be said right then and there and show it to your lawyer. | /r/Divorce_Men | 16/11/21 05:17 AM
Court tomorrow, need adviceSo the general rule I have seen courts take regarding relocation for a job is a parent can move wherever they want, but that doesn't mean they are allowed to take the child with them. So if she accepts the job and doesn't want to commute, then the child should be placed in your care and custody until a full hearing can be held. | /r/Divorce_Men | 05/11/21 03:14 PM
Court tomorrow, need adviceThe general rules regarding relocation is that there's nothing that would prohibit her from accepting the job, but she cannot take the child with her if it would negatively impact on your access schedule before there can be a hearing and testimony as to whether there should be a relocation of the child. Relocation rules really are for the child, not the parents. But, as I stated above, and for my own protection, the laws and caselaw are different from state to state, but I haven't seen any other… | /r/Divorce_Men | 05/11/21 02:53 PM
Court tomorrow, need adviceSo I'm not sure what state you are in, but I'm a NY divorce and custody lawyer (going through my own divorce), and I'll talk to you as if you were my client 1) do not speak up or say anything unless the Judge directly asks you anything. You have a lawyer, let your lawyer speak on your behalf. 2) since you won't be next to your lawyer, make sure the two of you have a quick way to communicate - text, IM, etc. If there are points the other side are making up, that are just lies, don't just write yo… | /r/Divorce_Men | 05/11/21 01:45 AM
Wife asked for Divorce today. Where do I get started?Speaking as a divorce attorney going through my own divorce, listen to all of this, with the caveat that some of the nuances can vary from state to state and county to county. For example, the majority of lawyers I deal with I've dealt with before, and the vast majority of those I have had success negotiating a settlement agreement. And that does mean a bunch of emails. Still better than a 2+ year slog through court. | /r/Divorce_Men | 31/10/21 04:54 AM
I’ve reached the end, sock dayI'm a New York family law and divorce attorney (also going through my own divorce). Would you mind sharing what judge it was? Or even the county? I'd be very interested based on your experience for future clients. | /r/Divorce_Men | 28/10/21 04:28 PM
Child supportWhat state are you in? Read below for a comment I just left about how in some states it doesn't make a difference if they have shared custody; child support remains the same. | /r/PussyPassDenied | 24/05/20 04:18 AM
Child supportThis really depends on what state you're in. I can tell you that in New York, if 51% of the year is spent with dad and 49% with mom, she pays full child support (at least up to the cap of $148,000). Even if they have straight 50-50 custody, if the mother earns more than the father she will have to pay support to him. Additionally, if a custody order has already been issued the only way to change it is by showing that there is a substantial change of circumstances that would warrant the change. | 14 | Judge Judy on child custody. Simple, Straight and Quick!Judge Judy used to be a Judge in the same building I currently practice law : Manhatten family court. I'd say there is a growing trend to view parents as equals and not have a preference for the mother. What depresses me, however, is most fathers assume the system is against them, that they have no shot at full custody and then they never try. And there are plenty of people fathers who I see file for joint custody immediately after being ordered to pay child support, motivated solely by the desi… | /r/MensRights | 10/06/18 03:14 PM
