I'm not asking what will happen if he/she lies, that is nothing new, and will not change much with this Yes means yes approach. I am asking whether Yes means yes changes things so sex without a positive, proactive consent is a crime? It looks like both parties could be charged somehow, as if neither consents with a 'yes', neither has given consent. Nothing changes about people lying, then can, and will do that. 1	How do you prove it wasn't rape? There are exceptions to many things. Police in Canada are able to use evidence gathered contrary to the law. https://en.wikipedia.org/wiki/Section_Twenty-four_of_the_Canadian_Charter_of_Rights_and_Freedoms I am reasonably sure other places have similar tests and uses, but I do not actually know.
